Ordinance No. 1,717ORDINANCE NO.1717 AN ORDINANCE OF THE CITY COUNCIL OF THECITY OF BAYTOWN,TEXAS, ACCEPTING THE BID OF WARREN BROTHERS COMPANY,GULF DISTRICT, DIVISION OF ASHLAND OIL,INC.FOR THE CONSTRUCTION OF THE STREET WORK ON THE DOWNTOWN IMPROVEMENT PROJECT AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUMOF FORTY- SEVEN THOUSAND THREE HUNDRED FORTY AND 60/100 ($47,340.60) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown,Texas,did authorize Jack Morton,City Engineer,to advertise for bids forthe construction of the street work on the Downtown Improvement Project to be receivedNovember 22,1974;and WHEREAS,notice to bidders asto the time and place,when and where the contract for said construction would be letwas published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly read at City Hall at 3:00 o'clock p.m.,Friday,November 22,1974,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown,Texas,hereby accepts the bid of Warren Brothers Company,Gulf District,Division of Ashland Oil,Inc.,according to the plans and specifications set forth by the City Engineer on a construction timetable of forty-five working days forthesum of Forty-Seven Thousand Three Hundred Forty and 60/100 ($47,340.60)Dollars,andthe Mayor and City Clerk ofthe City arehereby authorized and directed to execute and attest to a contract with Warren Brothers Company,Gulf District,Division of Ashland Oil,Inc.for theconstruction ofsaid street work,containing the plans, specifications,and requirements of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty- five (25%)percent or decreased by more than twenty-five (25%)percentwithout the consent of the contractor to such decrease. Section 3:This ordinance shall take effect from and after its passage bythe City Council of the City of Baytown.
