Ordinance No. 1,705ORDINANCE NO.1705 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,ACCEPTING THE PROVISIONS OF MINUTE ORDER NO.69360 ADOPTED OCTOBER 1,1974,BY THE TEXAS HIGHWAY COMMISSION WITH REGARD TO THE IMPROVEMENT OF BAYWAY DRIVE FROM SPUR 330,SOUTH TO CROW ROAD,ANDPROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the City of Baytown,hereby accepts the provisions of Minute Order No.69360 adopted October 1,1974,by the Texas Highway Commission with regard to the improvement of Bayway Drive from Spur 330,South to Crow Road.A copy of said Minute Order is attached hereto,marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown. Upon acceptance of the provisions of this Order by the appropriate officials of the City of Baytovn,IT IS ORDERED that Bayway Drive extending frota Spur 330,South to Crow Road,a distance of approximately 2.0 miles,be end is hereby designated as a HETR0- POIITAH HIGHWAY and the State Highway Engineer io directed to proceed vith the Reloca tion Assistance Prograia,to enter into agreccant with the City covering the details of the proposed improvements,to proceed with the engineering developtaent of the project and after the City has fulfilled its responsibilities,to proceed with construction us authorised herein In the most feasible and economical manner. It is understood that the City may discharge its construction obligations as outlined herein inany manner as they may elect.In the event the City desires the State to include its portion of the work in the State's construction contract,the State Highway Engineer is hereby authorized to enter into agreeoent with the City for such work and its cost as maybe agreed upon.'
