AN ORDINANCE OF THE CITY COUNCIL OF THECITY OF BAYTOWN,TEXAS,AMENDING
CHAPTER 28 1/2,"TAXATION,"BY REPEALING SUBSECTION 28 1/2.1(b)AS PRE
SENTLY CONSTITUTED AND SUBSTITUTING IN ITS PLACETHE PROVISIONS OF A NEW
SUBSECTION 28 1/2.1(b);REPEALING ORDINANCES INCONSISTENT HEREWITH;CON
TAINING A SAVINGS CLAUSE;AND PROVIDING FOR THEEFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the City of Baytown is hereby
amended bythe amendment of Chapter 28 1/2 "Taxation,"by repealing Subsection
28 1/2.1(b)thereof,andthe same shall cease to have force and effect from and
after the effective date of this ordinance.
Section 2:That the Codeof Ordinances is hereby amended by adding thereto
the provisions of a new Subsection 28 1/2.1(b)which shall read as follows,to wit:
Section 28 1/2.1.Exceptions to payment of ad valorem taxes.
(b)Subject to the provisions hereof,from and after January 1,
1974,$4,000 of the assessed value of residence homesteads,as defined
by the laws of the State of Texas,of married or unmarried persons
sixty-five (65)years of age or older,including those living alone
shall be exempted from ad valorem taxes levied by the City of Baytown.
Section 3:Repealing Clause:All ordinancesor partsof ordinances incon
sistent with the terms of this ordinance are hereby repealed;provided,however,
that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulativeof other ordinances regulating
and governing the subject matter covered by this ordinance.
Section 4:Savings Clause:If any provision,section,exception,sub
section,paragraph,sentence,clause or phrase ofthis ordinance or the application
of same to any person or set of circumstances,shall for any reason be held
unconstitutional,void or invalid,such invalidity shall not affect the validity
of the remaining provisionsof this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance
are declared to be severable.
Section 5:Effective Date:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
