AN ORDINANCE OF THE CITY COUNCIL OFTHE CITY OF BAYTOWN,TEXAS,
AMENDING CHAPTER 14,"GARBAGE AND TRASH,"ARTICLE II,COLLECTION
OF REFUSE,SECTION 14-24,CHARGE FOR COLLECTION,TO REPEALTHE
PROVISIONS OF SUCH SECTION AS PRESENTLY CONSTITUTED AND TO SUBMIT
IN ITS PLACE A NEW SECTION 14-24;REPEALING ORDINANCES INCON
SISTENT HEREWITH;CONTAINING A SAVINGS CLAUSE;AND PROVIDING FOR
THE PUBLICATION AND EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the Cityof Baytown is hereby
amended by the amendment of Chapter 14,"Garbage and Trash,"Article II,Collection
of Refuse,Section 14-24,Charge for collection,thereof and the same shall cease
to have force and effect from and after the effective date of this ordinance.
Section 2:That the Code ofOrdinances is hereby amended by adding thereto
a new Section 14-24,Charge for collection,which shall read as follows,to wit:
Section 14-24.Charge for collection.
The city shall charge for its services for removing and disposing
of garbage and refuse from houses,buildings,and premises used for
residential purposes the sum of Three Dollars ($3.00)per month for
each such residence,dwelling or apartment from which garbage iscol
lected,except when the sole occupant or the head of the household of
such residence,dwelling or apartment certifies in writing to the
Utility Collections Office that he is over sixty-five (65)years of
ageand that he will place no more than one thirty (30)gallon can of
garbage and refuse at his residence,dwelling or apartment for col
lection on each regularly scheduled collection day,in which case the
charge willbe the sum of One Dollar and seventy-five cents ($1.75).
In the case of multi-family dwellingunit projects,the monthly charge
for collection of garbage shall be the sum of Three Dollars ($3.00)
times the number of units in the project for which water charges are
made forthe month.
Section 3:Repealing Clause:All ordinances or parts of ordinances in
consistent with the terms of this ordinance are hereby repealed;provided,however,
that such repeal shall be only to the extent of such inconsistency and in all other
respects this ordinance shall be cumulativeof other ordinances regulating and
governing the subject matter covered by this ordinance.
Section 4:Savings Clause:If any provision,section,exception,sub
section,paragraph,sentence,clause or phrase of this ordinance or the application
of same to any person or setof circumstances,shall forany reason be held uncon
stitutional,void or invalid,such invalidity shall not affect the validity of the
remaining provisions of this ordinance or their application to otherpersons or set
of circumstances and to this end all provisions of this ordinance are declared to
be severable.
Section 5:Effective Date:The provisions of this ordinance shall be
come effectivebeginning with the first billing forthe month of October,1974.
The City Clerk is hereby directed to give noticehereof by causing the caption
of this ordinance to be published in the official newspaper of the Cityof Baytown
at least twice within ten days after the passage of this ordinance.
