Ordinance No. 1,668ORDINANCE NO.1668 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, AMENDING CHAPTER 31,"UTILITIES,"ARTICLE V,SEWER SERVICE, SECTION 31-65,SEWER SERVICE CHARGE,TO REPEAL THE PROVISIONS OF SUCH SECTION AS PRESENTLY CONSTITUTED AND TO SUBMIT IN ITS PLACE A NEW SECTION 31-65;REPEALING ORDINANCES INCONSISTENT HEREWITH;CONTAINING A SAVINGS CLAUSE;AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BEIT ORDAINED BY THE CITY COUNCILOFTHE CITY OF BAYTOWN,TEXAS: Section 1:That the Code of Ordinances ofthe City of Baytown is hereby amended by the amendment of Chapter 31,"Utilities,"Article V,Sewer Service,by repealing Section 31-65,Sewer Service Charge,thereof andthe same shall cease to have force and effect from and after the effective date of this ordinance. Section 2:That the Code of Ordinances is hereby amended by adding thereto a new Section 31-65,Sewer Service Charge,which shall read as follows,to wit: Section 31-65.Sewer service charge. A.Residential dwelling units. (1)Individually metered for water consumption:Each residential dwelling unit individually metered and billed for the consumption of water shall be charged forand owe each month a sewer service charge based upon the consumption of water attributed to it as determined by the provisions of this Code relating to water charges,applied to the following rates: Gallons of water used per month First 3,000 gallons Thereafter Sewer service rate to be charged $2.40 (minimum monthly rate) $0.40 per 1,000 gallons (2)Jointly metered for water consumption:Multi-family dwelling unit projects not individually metered for water shall be charged for and owe each month a sanitary sewer charge based upon consumption of water at tributed to it as determined by the provisionsof the Code relating to water charges applied to the following rates: Gallons of water used for month First3,000 gallons times the number of occupied units Excess of 3,000 gallons times the number of occupied units Sewer service rate to be charged $2.40 (minimum monthly rate) times the number of occupied units $0.40 per 1,000gallons (a)occupied units in the project shall be taken to be the total number ofunits in the project,unless the project manager shall report to the city on the form provided in Annex "A"the actual number ofoc cupied units as of the first dayof the current month.This report must be received by the city no later than the 10th day of the current month. B.Commercial units. Each commercial unit shall be charged for andowe each month a sanitary sewer service charge based upon the consumption of water attributed to it, as determined by the provisions of this Code relating to water charges, applied to the following rate schedule: Gallons of water used per month First3,000 gallons Thereafter C.Mobile homeparks. Sewer service rate to be charged $2.40 (minimum monthly rate) $0.40 per 1,000 gallons Mobile home parks shall be charged for and owe each a sanitary sewer service charge based upon consumption of water attributed to it as de termined by the provisions of this Code relating to water charges applied to the following rates: Gallons of water used per month First 3,000 gallons times the number of occupied spaces Excess of 3,000 gallons times the numberof occupied spaces Sewer service rate tobe charged $2.40 (minimum monthly rate) times the number of occupied spaces $0.40 per 1,000 gallons (a)occupied spaces in the project shall be taken to be the total number of spaces in the project,unless the project manager shall report to the city on the formprovided in Annex "A"the actual number of oc cupied spaces. (Signature)Manager or Owner Section 3:Repealing Clause:All ordinances or parts of ordinances in consistent with the terms of this ordinances are hereby repealed;provided,however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinancesregulating and governing the subject matter covered by this ordinance. Section 4:Savings Clause:If any provision,section,exception,sub section,paragraph,sentence,clause or phrase of this ordinance orthe application ofsame to any person orset of circumstances,shall for any reason be held uncon stitutional,void or invalid,such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or set of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5:Effective Date:The provisions of this ordinance shallbe- f^come effectivebeginning with the first billing for the month of October,1974. The CityClerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at leasttwice within ten days after the passage of this ordinance.
