Ordinance No. 1,657Ll 40 0 ORDINANCE NO. 1657 0 0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CONVEYANCE OF RIGHT OF WAY FOR STREET PURPOSES THROUGH LAND OWNED BY THE CITY OF BAYTOWN AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN INSTRUMENT GRANTING RIGHT OF WAY TO HARRIS COUNTY, CONTINGENT UPON THE COUNTY MOVING THE CITY'S FENCE, IF NECESSARY AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, Harris County is in need of acquiring right of way for street pur- poses through land owned by the City of Baytown; and WHEREAS, the City Council of the City of Baytown has determined that the City's use of the property in question will not be impaired by granting said right of way; and WHEREAS, Harris County has offered to pay the sum of Six Hundred Twenty- Six and No /100 ($626.00) Dollars for said right of way through the property described in Exhibit "A" attached hereto, which is owned by the City of Baytown; and WHEREAS, the Tax Department of the City of Baytown has made an appraisal of said right of way and has determined that the offer of Harris County is in excess of the fair market value of said right of way; and WHEREAS, Harris County has the power of eminent domain with the power to condemn property which it cannot purchase by agreement; and WHEREAS, in order to avoid the time consuming, tedious, and costly con- demnati.on proceedings, the City Council of the City of Baytown deems that it is in the best interest of the City to convey the right of way in question in con- sideration of the above stated amount; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown for the consideration herein set forth does hereby authorize the conveyance to Harris County of said right of way for street purposes through certain property owned by the City of Baytown, contingent upon the County moving the City's fence, if necessary; said property being described in Exhibit "A" which is attached hereto and made a part hereof for 0 all intents and purposes. 0 Section 2: That upon receipt of the consideration set forth herein, the Mayor is hereby authorized and directed to execute and the City Clerk attest to an instrument granting such right of way. Section 3: That the City Council hereby authorizes the acceptance of the sum of Six Hundred Twenty -Six and No /100 ($626.00) Dollars as consideration for said right of way described in Exhibit "A." Section 4: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
