AN ORDINANCE ORDERING A SPECIAL MUNICIPAL ELECTION TO BE HELD ON THE
3RD DAYOF OCTOBER 1974,FOR THE PURPOSE OF DETERMINING
WHETHER THE STATE LAW AUTHORIZING COLLECTIVE BARGAINING FOR FIREFIGHTERS
SHALL BE ADOPTED;PROVIDING FOR ELECTION OFFICERS;PRESCRIBING THE HOURS;
PROVIDING FOR A CANVASSING BOARD FOR ABSENTEE BALLOTS;PROVIDING FOR THE
POSTING AND PUBLICATION OF NOTICE;AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
Pursuant to Article 5154c-l,V.A.T.S.,providing for the manner of determining
whether the statelaw authorizing collective bargaining for firefighters shall be
adopted.
BEIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That a special Municipal Election of the City of Baytown,pro
vided for in Article 5154c-l,V.A.T.S.,shall be held between the hours of 7:00
a.m.and 7:00 p.m.on the 3rd day of October ,1974 for the purpose
of determining whether the state law authorizing collective bargaining for fire
fighters shallbe adopted.
Section 2:That said City is hereby divided into Election Precincts and
their polling places will be and election officials shall be,for the purpose
of this Election as follows:

Section 3:At said election the following proposition shall be submitted in
accordance with law:
"FORor AGAINST the following:
Adoption of the state law applicable to 'firefighters,1 which establishes
collective bargaining when a majority of the affected employees favor re
presentation by an employees'association and which preserves the prohibition
of strikes and lockouts and provides penalties therefor."
Section 4:Voting machines shall be used at said election except that paper
ballots shall be used for absentees voting by mail;and the official ballots for
the election shall be prepared in accordance with the Texas Election Code and
Article 5154C-1,V.A.T.S.,soas to permit the electors to vote "FOR"or "AGAINST"
the aforesaid proposition which shall be set forth on all official ballots in sub
stantially the following form:
FOR ADOPTION OF THE STATE LAW APPLICABLE TO "FIREFIGHTERS,"
WHICH ESTABLISHES COLLECTIVE BARGAINING WHEN A MAJORITY
OF THE AFFECTED EMPLOYEES FAVOR REPRESENTATION BY AN
)EMPLOYEES'ASSOCIATION AND WHICH PRESERVES THE PROHI-
[]AGAINST )THEREFOR.)BITION OF STRIKES AND LOCKOUTS AND PROVIDES PENALTIES
Section 5:That the Election shall be held in accordancewith,and shall
be governed by,the election laws of the State of Texas.In all City elections
the Mayor,City Clerk or the City Council shall doand perform each act as in
jpv other elections required tobe done and performed,respectively,by the County
Judge,the County Clerk or the Commissioners'Court.The noticeof proclamation
ofthis and all other City Elections shall be issuedand posted at the polling
places not later than twenty (20)days before the date of said Election.
Section 6:Each qualified voter who desires to cast an absentee vote and
who expects tobe absent on the day of this election,shall be entitled to an
official ballot andthe right to cast such ballot in accordance with the pro
visions of the Texas Election Code of 1951,as amended.

Section 7:Each elector using a voting machine and desiring to vote in
favor of the proposition shall move the voting pointer soasto indicate "FOR"
the proposition,and each elector desiring to vote against the proposition shall
move the pointer so as to indicate "AGAINST"the proposition.Each absentee
elector voting by mail and using a paper ballot shall vote on each proposition
by placing an "X"or other clear mark in the squarebeside the statement in
dicating the way such elector wishes to vote on the proposition.
Section 8:Councilman Jodv Lander is hereby
designated as the member of the City Council to canvass the voting machine used
f^in absentee voting,together with the Mayor and City Clerk as provided for in
Article 7.14,Section 7,of the Election Code,Vernon's Annotated Civil Statutes.
Section 9:The Chief of Police is hereby directed to post a properly ex
ecuted copy ofthe Election Proclamation and Notice ateach Polling Place within
the City,said Notice shall be posted not less than twenty (20)days before the
date of said Election.The Mayor is hereby directed to give notice of said
Election by publishing a copy of the Election Proclamation and Notice in a news
paper of general circulation within saidCity;said publication to be made not
more than twenty-five (25)days nor less than ten (10)days before said election.
Section 10:This ordinance shall take effect immediately from and after
_^its passage by the City Council of the City of Baytown.
