Ordinance No. 1,6230*f ORDINANCE NO.1623 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, ACCEPTING THE BID OF CHATHAM AND HOLZAEPFELOF BAYTOWN FOR THE CONSTRUCTION OF FIRE STATION NO.6 AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF FIFTY-ONE THOUSAND TWO HUNDRED TWENTY-ONE AND NO/100 ($51,221.00)DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown,Texas,did authorize Davis &Burge,Architects -Planners,Inc.,Consulting Architects to the City ofBaytown, to advertise for bids for the construction of Fire Station No.6 to be received June 25,1974;and WHEREAS,notice to bidders asto the time and place,when and where the contract for said construction would be letwas published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly readat City Hall at 4:00 o'clock p.m.,Tuesday,June 25,1974,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown,Texas,hereby accepts the bid of Chatham and Holzaepfel of Baytown,according to the plans and specifications set forth by the Consulting Architects on a construction timetable of 14 weeks for the sum of Fifty-One Thousand Two Hundred Twenty-One and No/100 ($51,221.00)Dollars,and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Chatham andHolzaepfel for the construction of said fire station,containing the plans, specifications,and requirements of the ConsultingArchitects and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes,Article 5160. Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve anychange order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty- five (25%)percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
