AN ORDINANCE OF THE CITY COUNCIL OFTHE CITY OF BAYTOWN,TEXAS,AMENDING
ORDINANCE NO.966 BY THE AMENDMENT OF THE "PERSONNEL POLICIES OF THE CITY
OF BAYTOWN,"SECTION 3.10,INJURY LEAVE,SO AS TO REPEAL THE PROVISIONS
OF SUCH SECTION AS PRESENTLY CONSTITUTED AND TO SUBSTITUTE IN ITS PLACE
A NEW SECTION 3.10;REPEALING ORDINANCES INCONSISTENT HEREWITH;CONTAINING
A SAVINGSCLAUSE;AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BEIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That Ordinance No.966 is hereby amended by the amendment of
the "Personnel Policies of the City of Baytown"by repealing Section 3.10,Injury
Leave,thereof,andthe same shall cease to have force and effect from and after
the effective date of this ordinance.
Section 2:That the "Personnel Policies of the City of Baytown"are hereby
amended by adding thereto a new Section 3.10,Injury Leave,which shall read as
follows,to-wit:
Section 3.10.Injury Leave.
Employee injured on the job in the lineof duty shall be granted injury
leave,not charged against his sick leave or vacation,to extend for such
time as the injured employee is unable to return to work,but in no event
to extendbeyond six (6)months.Duringsuch period he shall be paid by
the City at full pay less weekly Workmen's Compensation benefits.Paid
injury leave provided for herein shall never be paid for a periodlonger
than the period compensated by Workmen's Compensation benefits.
Section 3:Repealing Clause:All ordinances or parts of ordinances incon
sistent with the terms of this ordinances are hereby repealed;provided,however,
that such repealshall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other ordinancesregulating
and governing the subject matter covered by this ordinance.
Section 4:Savings Clause:If any provision,section,exception,sub
section,paragraph,sentence,clause or phrase of this ordinance or the application
of same to any person or set of circumstances,shall foranyreason be held
unconstitutional,voidor invalid,such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their application to other
persons or setsof circumstances and to this end all provisions of this ordinance
are declared tobe severable.
Section 5:Effective Date:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
