Ordinance No. 1,611ORDINANCE NO.1611 AN ORDINANCE OFTHECITY COUNCIL OFTHECITY OF BAYTOWN,TEXAS, DECLARING THAT AN EMERGENCYSITUATION EXISTS,AUTHORIZING THE MAYOR ANDTHECITY CLERK TO EXECUTEAND ATTEST TO A CONTRACT WITH CHANNEL CONSTRUCTION COMPANY,INC.FOR THE REPAIR OF A SEWER LINEAND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF EIGHTEEN THOUSAND EIGHT HUNDRED FORTY- SIX AND NO/100 ($18,846.00)DOLLARS WITH REGARD TO SUCH AGREEMENT WHEREAS,their exists on WestTexas Avenue from 100'North of Laredo,South to theWest Texas Avenue LiftStation a sewer main in a present state of disre- pair due to pipe deterioration and resulting cave-ins;and WHEREAS,said sewer line services a large area and a great number of people; and WHEREAS,it is necessary to perserve and protect the publichealth of the citizensof the City of Baytown;and WHEREAS,considering the above,the City Council of the City of Baytown, deems that an emergency situation exists;NOW THEREFORE, BEIT ORDAINED BY THE CITY COUNCIL OF THECITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the CityofBaytown,Texas,hereby declares that an emergency situation exists. Section 2:That the Mayor and CityClerkof the City of Baytown are hereby authorized and directed to enter into a contract containing the usual performance and payment bond provisions with Channel Construction Company,Inc.for the repair of a sewer mainexisting on WestTexas Avenue from 100'North of Laredo,South to the WestTexas Avenue Lift Station on a construction timetable of 10 working days, and authorizes the contracting of indebtedness by the Cityof Baytown for the sum of Eighteen Thousand EightHundred Forty-Six and No/100 ($18,846.00)Dollars. Section 3:That,pursuant to the provisions of Article 2368a,Section 2a, Vernon's Annotated Texas Statutes,the City Manager is hereby granted general au thority to approveany change order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty-five (25%)percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 4:This ordinance shall take effect fromand after its passage by the City Council of the City of Baytown.
