Ordinance No. 1,602ORDINANCE NO.1602 AN ORDINANCEPROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN,TEXAS,ANDTHE ANNEXATION OF CERTAIN TERRITORY,WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. WHEREAS,a public hearing before the City Council oftheCity of Baytown, Texas,where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described property,to-wit: BEING a 26.384 acre tract of land out of the David McFadden Survey,A-591, and the J.W.Singleton Survey,A-709,Harris County,Texas,and being northof the City of Baytown,Harris County,Texas,and being more parti cularly described by metes and bounds as follows: COMMENCING at the point of intersection of the North line of Massey- Tompkins Road with the Northwesterly right ofway line of the Dayton-Goose Creek Railroad; THENCE,South 81 degrees 10 minutes 37 seconds West,with the north line of Massey-Tompkins Road,a distance of 106.26 feet to a point; THENCE,North 11 degrees 15 minutes 55 seconds West,a distance of 814.49 feet to a point; THENCE,South 82 degrees 58 minutes 14 seconds West,a distance of 267.03 feet to a point,said point lying at the southwest corner of Chaparral Village Section One Subdivision,being on the corporate boundaryof the City of Baytown,and being the POINT OF BEGINNING; THENCE,South 46 degrees 58 minutes 25 seconds West,over and across Chaparral Drive (called Barkuloo Road No.2),a distance of 70.57 feet to a point in the west right ofway line of ChaparralDrive; THENCE,South 80 degrees 19 minutes 18 seconds West,a distance of 687.45 feet to a point; THENCE,North 11 degrees 34 minutes 29 seconds West,a distance of 1519.13 feet to a point; THENCE,along a curve to the right having a radius of 2241.83 feet and a delta angle of 4 degrees 21 minutes 16 seconds for a distance of 170.378 feet to a point; THENCE,North 78 degrees 32 minutes 32 seconds East,a distance of 580.0 feet to a point,said pointlying in the easterly right of way line of Chaparral Drive and being on the corporate boundary of the City of Baytown; THENCE,South 27 degrees 28 minutes 28 seconds East,along said right of way lineand said corporate boundary,a distance of 1508.9 feet(+) to the POINT OF BEGINNING.(Chaparral Village,Section 3) was held at 7:00 o'clock p.m.in the City Council Chamber of the City Hall of the City of Baytown,Texas,on the 9th day of May,1974,which date is not more than twenty (20)nor less than ten (10)days prior to the institution of annexation proceedings;and WHEREAS,notice of such public hearing was published in a newspaper having general circulation in the City of Baytown,Texas,and in the above described territory on the 28th day ofApril,1974,which date is not more than twenty (20)nor less than ten (10)days prior to the date of such public hearing;and WHEREAS,the total corporate area of the City ofBaytown,Texas on the 1st day of January,1974,was 17,274 acres;and WHEREAS,the population of the City of Baytown,Texas,is approximately 50,000 inhabitants;and WHEREAS,the above described territory lies within the extraterritorial jurisdiction of the City of Baytown,Texas;and WHEREAS,the above described territory lies adjacent to and adjoins the City of Baytown,Texas;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the following described land and territory lying ad jacent to and adjoining theCity of Baytown,Texas,is hereby added and annexed to the City of Baytown,Texas,and the said territory hereinafter described shall hereafter be included within the boundary limits of the City of Baytown, Texas,andthe present boundary limits of such City,at the various points contiguous to the area hereinafter described,are altered and amended so as to include said area within the corporate limits of the City of Baytown,Texas, to-wit: BEING a 26.384 acre tract of land out of the David McFadden Survey,A-591, and the J.W.Singleton Survey,A-709,Harris County,Texas,and being north of the City of Baytown,Harris County,Texas,andbeing more parti cularly described by metes and bounds as follows: COMMENCING at the point of intersection of the North line of Massey- Tompkins Road with the Northwesterly right of way line of the Dayton-Goose Creek Railroad; THENCE,South 27 degrees 28 minutes 28 seconds East,along said right of way line and said corporate boundary,a distance of 1508.9 feet(+_) to the POINT OF BEGINNING.(Chaparral Village,Section 3) Section 2:The above described territory and the area so annexed shall be a part of the City of Baytown,Texas,andthe property so addedhereby shall bear its pro rata part of the taxes levied by the City of Baytown,Texas, andthe inhabitants thereof shall be entitled to all of the rights and privi leges of all the citizens and shall be bound by the acts,ordinances,resolutions, and regulations of the City of Baytown,Texas. Section 3:This ordinance shall be published and passed in the manner provided in Article 1,Section 9 of the Charter of the City of Baytown,Texas.
