AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE CONVEYANCE OF RIGHTS OF WAY AND PIPELINE EASEMENTS
UNDER, UPON, OVER, AND THROUGH LANDS OWNED BY THE CITY OF BAYTOWN.
AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST
INSTRUMENTS GRANTING RIGHTS OF WAY AND PIPELINE EASEMENTS TO
TEXAS EASTERN TRANSMISSION CORPORATION AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS,.Texas Eastern Transmission Corporation is in need of purchasing
rights of way and pipeline easements upon, over, and through lands owned by the
City of Baytown; and
® WHEREAS, the City Council of the City of Baytown has determined that the
City's use of the property in question will not be impaired by granting said
rights of way.and pipeline easements; and
WHEREAS, Texas Eastern. Transmission Corporation has offered to pay the
sums of Three Hundred Thirty and No /100 ($330.00) Dollars, Four Hundred Forty
and No. /1.0.0 ( ,$440.00): Dollars., and Three Thousand Eight Hundred Fifty and No /100
($3,850.001.Dollars respectively for rights of way and pipeline easements
under, upon,.over, and through the property described in Exhibits "A," "B,"
and "C" attached hereto, .which i,s.,owned. by�,fthe ,4C_ :ty,of Baytown,;,;andd
WHEREAS,.tfhe Tax Department of the City of Baytown has made appraisals of
said rights of way and pipeline easements and has. determined that the offer of
® Texas Eastern Transmission Corporation is in excess of the fair market value
of said rights of way and pipeline easements; and
WHEREAS, Texas Eastern Transmission Corporation has the power of eminent
domain with the power to .condemn property which it cannot purchase by agreement;
and
WHEREAS, in order to avoid the time consuming, tedious, and costly con-
demnation proceedings, the City Council of the City of Baytown deems that
it.is in the best interest of the City to convey the rights of way and pipeline
easements. in question in consideration of the above stated amounts; NOW THEREFORE,
BE IT ORDAINED.B.Y THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:

Section 1: That the City Council of the City of Baytown for the consideration
herein set forth does hereby authorize the conveyance to Texas Eastern Trans-
mission Corporation of rights of way and easements for the construction, laying,
maintenance, operation., alteration, repairing, removal, changing of size and
replacement of pipelines and appurtenances thereto under, upon, over, and
through certain property owned by the City of Baytown and described in Exhibits
"B," and. "C" which are attached hereto and made a part hereof for all
intents and purposes.
Section 2: That upon receipt of the consideration set forth herein,
the Mayor is hereby authorized and directed to execute and the City Clerk
to attest.instruments granting such rights of way and pipeline easements.
Section 3: That the City Council hereby authorizes the acceptance of
the sums of Three Hundred.Thirty and No /100 ($330.00) Dollars, Four Hundred
Forty and No /100 C$440.00) Dollars, and Three Thousand Eight Hundred Fifty
and No /100 ($3',850.:00).Dollars respectively as consideration for rights, of
way and pipeline easements described in Exhibits "A," "B," and "C."
Section 4: This.ordi.nance sliali take effect from and after its passage
by the City.Councia of the City of Baytown.
INTRODUCED, READ.and PASSED by the affirmative vote of the City Council
of the City.of Baytown this 9th day of May, 1974.
