Ordinance No. 1,591■■ ORDINANCE NO.1591 AN ORDINANCE ORDERING A SPECIAL MUNICIPAL ELECTION TO BE HELD ON THE 18TH DAY OF .illMF -.1974,FOR THE PURPOSE OF DETERMINING WHETHER TO INCREASE THE MINIMUM SALARY FOR FIREMEN AND POLICEMEN;PRO VIDING FOR ELECTION OFFICERS;PRESCRIBING THE HOURS;PROVIDING FOR A CANVASSING BOARD FOR ABSENTEE BALLOTS;PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE;AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Pursuant to Article 1269q,V.A.T.S.,providing forthe manner of increasing the minimum monthly salary forFiremen and Policemen. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF BAYTOWN,TEXAS: Section 1:That a special Municipal Election of the City of Baytown,pro vided for in Article 1269q,V.A.T.S.,shall be held between the hours of7:00 a.m.and 7:00 p.m.on the 18th day ofJune t 1974 for tne purpOse of determining whether or not the proposed minimum monthly salaryof $734.00 per monthfor Firemen and Policemen shall be adopted. Section 4:Voting machines shall be used at said election except that paper ballots shall be used for absentee voting by mail;and the official ballots for the election shall be prepared in accordance with the Texas Election Code and Article 1269q,V.A.T.S.,so asto permit the electors to Vote "FOR"or "AGAINST" the aforesaid proposition which shall be set forth on all official ballots in substantially the following form: []FOR )THE PROPOSED MINIMUM SALARYOF )-$734.00 PER MONTH FOR FIREMEN []AGAINST )AND POLICEMEN Section 5:That the Election shall be held in accordance with,and shall be governed by,the election laws of the State of Texas.In all City elections the Mayor,City Clerk or the City Council shall doand perform each act as in other elections required to be done and performed,respectively,by the County Judge,the County Clerk or the Commissioners'Court.The notice of proclamation of this and all other City Elections shall be issued and posted at the polling places not later than twenty (20)days before the date of said Election. Section 6:Each qualified voter who desires to cast an absentee vote and who expects to be absent on the day of this election,shall be entitled to an official ballot and the right to cast such ballot in accordance with thepro visions of the Texas Election Code of 1951,as amended. Section 7:Each elector using a voting machine and desiring to vote in favor of the proposition shall move the voting pointer so as to indicate "FOR"the proposition,and each elector desiring to vote against the proposition shall move the pointer so as to indicate "AGAINST"the proposition.Each absentee elector voting by mail and using a paper ballot shall vote on each proposition by placing an"X"or other clear mark in the square beside the statement indicating the way such elector wishes to vote on the proposition. -4- Section 8:The Mayor Pro Tem Is hereby designated as the member of the City Council to canvass the voting machine used in absentee voting,together with the Mayor and City Clerk as provided for in Article 7.14,Section 7,of the Election Code,Vernon's Annotated Civil Statutes. Section 9:The Chief ofPolice is hereby directed to post a properly executed copy of the Election Proclamation and Notice ateach Polling Place within the City,said Notice shall be posted not less than twenty (20)days before the date of said Election.The Mayor is hereby directed to give notice ofsaid Election by publishing a copyoftheElection Proclamation and Notice in a newspaper of general circulation within said City;said publication tobe made not more than twenty-five (25)days nor less than ten (10)days before said election. Section 10:This ordinance shall take effect immediately from and after its passage by the City Council of the CityofBaytown.
