Ordinance No. 1,590ORDINANCE NO.1590 AN ORDINANCE OFTHE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, ACCEPTING THE BID OF BROWN &ROOT,INC.FOR THE CONSTRUCTION OF THE 1974 STREET IMPROVEMENT PROGRAM,PHASE II AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF ONE HUNDRED NINETY-FOURTHOUSAND SIX HUNDRED EIGHTY-TWO AND 10/100 C$194,682.10)DOLLARS WITH REGARD TOSUCH ACCEPTANCE. WHEREAS,the City Council of the City of Baytown,Texas,did authorize Jack Morton,City Engineer forthe City of Baytown,to advertise for bids forthe construction of the 1974 Street Improvement Program,Phase II to be received April 18,1974;and WHEREAS,notice to bidders as to the time and place,when and where the contract for said constructionwould be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly read at City Hall at 3:00 o'clock p.m.,Thursday,April 18,1974,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown,Texas,hereby accepts the bid of Brown &Root,Inc.,according to the plans and specifications set forth by the City Engineer on a construction timetable of Eighty (80)working daysforthesum of One Hundred Ninety-Four Thousand Six Hundred Eighty-Two and10/100 ($194,682.10)Dollars,andthe Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Brown &Root,Inc.for the construction of said street improvement program,containing the plans,specifi cations,and requirements of the CityEngineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes,Article 5160. Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve anychange order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty- five (25%)percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
