Ordinance No. 1,574ORDINANCE NO.1574 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OFBAYTOWN,TEXAS, ACCEPTING THE BID OF FAIRMONT PAVING COMPANY FOR THE DEVELOPMENT OFTHE LEAGUE OF WOMEN VOTERS PARK AND AU THORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OFFIFTY THOUSAND SEVENTY-SIX AND NO/lOO ($50,076.00) DOIURS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown,Texas,did authorize Busch, Hutchison &Associates,Inc.,Consulting Engineers to the City of Baytown,toad vertise for bids for the development of the Leagueof Women Voters Park tobe received April 4,1974;and WHEREAS,notice to bidders asto the time and place,when and where the contract for said constructionwould be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly readat City Hall at10:00o'clock a.m.,Thursday,April 4,1974,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown,Texas,hereby accepts the bid of Fairmont Paving Company ,according to the plans and specifications set forth by the Consulting Engineers on a construc tion timetable of 90 working days forthesumof Fifty Thousand Seventy-Six and No/100 ($50,076.00)Dollars,and the Mayor and City Clerk ofthe City are hereby authorized and directed to execute and attest to a contract with Fairmont Paving Company for the development of said park, containing the plans,specifications,and requirements of the Consulting Engineers and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes,Article 5160. Section 2:That,pursuant to the provisions ofArticle 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority .to approve anychange order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the 0^ proviso that the original contract price may not be increased by more than twenty-five (25%)percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
