AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
ACCEPTING THE BID OF pflTpMnMT pautmc re
FOR THE DEVELOPMENT OF JENKINS-HOLLOWAY MEMORIAL PARK,JOB NO.
72-537,AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE
CITY FOR THE SUM OF EIGHTY-FOURTHOUSAND EIGHT HUNDRED EIGHTY-
EIGHT AND 70/100 ($84.888.70)DOLLARS
WITH REGARD TOSUCH AGREEMENT.
WHEREAS,the City Council of the City of Baytown,Texas,did authorize Busch,
Hutchison &Associates,Inc.,Consulting Engineers to the City of Baytown,to
advertise for bids for the development of Jenkins-Holloway Memorial Park to
be received April 4,1974;and
WHEREAS,notice to bidders as to the time and place,when and where the
contrast for said development would be letwas published pursuant to provisions
of Vernon's Civil Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City Hall at 10:15 o'clock
a.m.,Thursday,April 4,1974,as per published notice to bidders;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1:That the City Council of the City of Baytown,Texas,hereby
accepts the bid of Fairmont.Paving Company according to the
plans and specifications set forth by the Consulting Engineers on a construction
timetable of _6j}working days for thesum of Eiohtv-Fnur Thousand Fight HunrirpH
Eighty-Eight and 70/100 ($84,888.70)Dollars,and the Mayor and City
Clerk of the City are hereby authorized and directed to execute and attest to
a contractwith Fairmont Paving Company for the development of
said park,containing the plans,specifications,and requirements of the Consulting
Engineers and appropriate bondand drawn provisions in accordance with the provisions
of Vernon's Civil Statutes,Article 5160.
Section 2:That,pursuant to the provisions of Article 2368a,Section
2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general
authority to approve anychange order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the
proviso that the original contract price may not be increased by more than twenty-
five (25%)percent or decreased by more than twenty-five (25%)percent without
the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect from and after its passage
by the City Council of the City of Baytown.
