Ordinance No. 1,569■b ORDINANCE NO.1569 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,ACCEPTING THE BIDOF G.G.ROSS,INC.FOR THE CONSTRUCTION OF WATER MAINS IN GLEN ARBORANDCREEKWOOD SUBDIVISIONS,JOB NO.73-555 AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF TWO HUNDRED SEVENTY-EIGHT THOUSAND NINE HUNDRED FORTY-FIVE AND NO/100 ($278,945.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown,Texas,did authorize Busch, Hutchison &Associates,Inc.,Consulting Engineers to the City ofBaytown,to advertise for bids for the construction of watermains in Glen Arbor and Creekwood Subdivisions to be received March 19,1974;and WHEREAS,notice to bidders as to the time and place,when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly read at City Hall at W:3n o'clock _a_.m.,Tuesday,March 19,1974,as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown,Texas,hereby accepts the bid ofG.G.Ross,Inc.,according to theplans and specifications set forth by the Consulting Engineers on a construction timetable of 120 working days for the sum of Two Hundred Seventy-Eight Thousand Nine Hundred Forty-Five and No/100 ($278,945.00)Dollars,and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with G.G. Ross,Inc.forthe construction ofsaid water mains,containing the plans,specifi cations,and requirements ofthe Consulting Engineers and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. Section 2:That,pursuant to the provisionsof Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve any change order involving a decrease oran increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty- five (25%)percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
