AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
ACCEPTING THE BID OF MCKEY CONSTRUCTION ANDEQUIPMENT RENTALS,INC.
OF LAPORTE FOR THE CONSTRUCTION OF GOOSECREEK DRIVE STORM SEWER
AND SANITARY SEWER RELIEF SYSTEMS AND AUTHORIZING THE CONTRACTING
OF INDEBTEDNESS BY THE CITY FOR THESUM OF FIFTY-THREE THOUSAND
SIX HUNDRED FIFTY-EIGHT AND NO/100 ($53,658.00)DOLLARS WITH
REGARD TO SUCH AGREEMENT.
WHEREAS,the City Council of the City of Bay town,Texas,did authorize Busch,
Hutchison &Associates,Inc.,Consulting Engineers to the City of Baytown,to
advertise for bids for the construction of Goose Creek Drive Storm Sewer and Sanitary
Sewer Relief Systems to be received March 19,1974;and
WHEREAS,notice to bidders as to the time and place,when and where the
contract for saidconstruction would be let was published pursuant to provisions
of Vernon's Civil Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City Hall at 10:45 o'clock
a.m.,Tuesday,March 19,1974,as per published notice to bidders;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1:That the City Council of the City of Baytown,Texas,hereby
acceptsthe bid of McKey Construction and Equipment Rentals,Inc.of LaPorte,
according to the plans and specifications set forth by the Consulting Engineers
on a construction timetable of forty-five (45)working days for the sum ofFifty-
Three Thousand Six Hundred Fifty-Eight and No/100($53,658.00)Dollars,and
the Mayor and City Clerk of the City are herebyauthorized and directed to execute
and attest to a contract withMcKey Construction and Equipment Rentals,Inc.for
the construction of said stormsewer and sanitary sewer relief systems,containing
the plans,specifications,and requirementsof the Consulting Engineers and
appropriate bond and drawn provisions in accordance with the provisions of Vernon's
Civil Statutes,Article 5160.
Section 2:That,pursuant to the provisions of Article 2368a,Section
2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general
authority to approve any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the
proviso that the original contract price may not be increased by more than twenty-
five (25%)percent or decreased by more than twenty-five (25%)percent without
the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect from and after its passage
by the City Council of the City of Baytown.
