AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
ACCEPTING THE BID OF WHITELAK,INC.FOR THE CONSTRUCTION PROJECT
44A,CONTRACT NO.7,BAKER-DECKER AND SPORTS COMPLEX SANITARY
SEWERS;AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY
FOR THE SUMOF ONE MILLION THREE HUNDRED THIRTY THOUSAND FORTY-
EIGHT AND NO/100 ($1,330,048.00)DOLLARS WITH REGARD TO SUCH AGREEMENT.
WHEREAS,the City Council of the City of Baytown,Texas,did authorize Langford
Engineering,Consulting Engineers to the City of Baytown,to advertise for
bids for the construction of Project 44A,Contract No.7,Baker-Decker and Sports
Complex Sanitary Sewers to be received on the 12th day of February,1974;and
WHEREAS,notice to bidders as to the time and place,when and where the
contract for said construction would be let was published pursuant to provisions
of Vernon's Civil Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City Hall at 5:00
o'clock_p_.m.,on the 12thday of February,1974,as per published notice
to bidders;NOW THEREFORE,
BEIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1:That the City Council of the City of Baytown,Texas,hereby
accepts the bid of Whitelak,Inc.,according to the plans and specifications
set forth by the Consulting Engineers on a construction timetable of 250
calendar days for the sum of One Million Three Hundred Thirty Thousand Forty-Eight
and No/100 ($1,330,048.00)Dollars,andthe Mayor and City Clerk of the City
are hereby authorized and directed to execute and attest to a contractwith Whitelak,
Inc.forthe construction of said sanitary sewers,containing the plans,specifica
tions,and requirements of the Consulting Engineers and appropriate bond and
drawn provisions in accordance with the provisions of Vernon's Civil Statutes,
Article 5160.
Section 2:That,pursuant to the provisions of Article 2368a,Section
2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general
authority to approve any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the
proviso that the original contract price may not be increased by more than
twenty-five (25%)percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect from and after its passage
by the City Council of the City of Baytown.
