Ordinance No. 1,548ORDINANCE NO.1548 AN ORDINANCE DISCONTINUING,ABANDONING FOR PUBLIC USE AND CLOSING DESCRIBED PORTIONS OF STREETS IN BUSCH TERRACE SUBDIVISION IN THE CITY OF BAYTOWN AND ABANDONING AND QUIT-CLAIMING ALL INTERESTOF THE CITYOF BAYTOWN AND THE PUBLIC IN AND TO SAID PORTIONS OF STREETS,DIRECTING THAT THE COUNTY CLERK OF HARRIS COUNTY,TEXAS,SO INDICATE ON THE RECORDED PLAT OF SAID SUBDIVISION,ANDAUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST A CONVEYANCE TO THE ABUTTING OWNERS. WHEREAS,the following portions of streets in Busch Terrace Subdivision in the City of Baytown,Harris County,Texas,according to the map and plat thereof recorded in Volume 9,Pages 10 and 11,of the Deed Records of Harris County,Texas,are notnow used by the public: Dorris Street Parcel 1: Beginning at the southeast corner of Block 25 of said subdivision; Thence N 56°W 520 feet along the northline of Dorris Street to a point in the southeast corner of Block 23; Thence S 34°W 60 feet along the west line of Dorris Street to a point in the northeast cornerof Block 36; Thence S 56°E 520 feet along the south line of Dorris Street to a point in the northeast corner of Block 38; Thence N 34°E 60 feet along the west line of Airhart Drive to the point of beginning and containing .7162 acre,more or less. Crawford Street Parcel 2: Beginning at the northeast corner of Block 36 of said subdivision; Thence S 34°W 200 feet along the west lineof Crawford Street to a point in the southeast corner of Lot 12,Block 36; Thence S 56°E 60 feet along the south line of Crawford Street to a point in the southwest corner of Lot 45,Block 37; Thence N 34°E 200 feet along the east line of Crawford Street to a point in the northwest corner of Block 37; Thence N 56°W 60 feet to the point of beginning and containinq .275482 acre,more or less. WHEREAS,no interest of the public requires that said portions of streets be improved or kept open,but the needs of the public will be adequately served by theuse of other available streets;and WHEREAS,the interestof the public will be benefited by the termination of any obligation on the partof the City of Baytown to repair,improve and maintain saidportions of streets as public ways;and WHEREAS,substantially all of the utility facilities,if any,provided for property abutting upon the above-described portions of streets have here tofore beenremoved;and WHEREAS,all of the owners ofproperty abutting or adjoining the above- described portions of streets in said subdivision have made application that same be discontinued,closed and abandoned as streets and that the dedications made in connection with said map or plat of Busch Terrace Subdivision of re cord as aforesaid be cancelled and held for naught insofar as the same apply to and affect the above-described portions of streets;and WHEREAS,it appears to beto the best interest of the Cityof Baytown, Harris County,Texas,that the above-described portions of streets be dis continued,closed and abandoned as streets and that the corresponding portions of said map or plat be vacated,and it further appears that the interest of no other owners of property in said Busch Terrace Subdivision willbe pre judiced orimpaired thereby;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THECITYOF BAYTOWN,TEXAS: Section 1:That the above-described portions of streets in Busch Terrace Subdivision,City of Baytown,Harris County,Texas,according to the map or plat of said subdivision of record in Volume 9,Pages 10 and 11 of the Deed Records of Harris County,Texas,be andthe same are hereby discontinued and abandoned for public use,and the City of Baytown does for itself andfor the public abandon and quit claim all interest in and to the above-described portions of streets and does hereby approve the application of said owners of the property abutting said portions of streets,and the County Clerk of -2- Harris County,Texas,is directed to write across the corresponding portions of said plat the word "closed"and also to make reference on the same to the volume and page in which this ordinance is recorded.The Mayor is hereby authorized to execute and the City Clerk to attest appropriate conveyances of saidportions of streets to the owners of propertyabutting same. Section 2:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
