Ordinance No. 1,547ORDINANCE NO.1547 AN ORDINANCE OF THE CITY COUNCIL OF THE CITYOF BAYTOWN,TEXAS, AMENDING THE ASSESSMENT ROLL AS ADOPTED BY ORDINANCE NO.1273 THE 14TH DAY OFSEPTEMBER,1972,ON THE WORK OF IMPROVING CER TAIN PORTIONS OF CROW ROAD,MAPLETON AVENUE,SOUTH BAYSHORE DRIVE,WEST BAYSHORE DRIVE,EAST BAYSHORE DRIVE,AND BROWNWOOD DRIVE IN THE CITY OF BAYTOWN,TEXAS,AND PROVIDING FORTHE EF FECTIVE DATE HEREOF. WHEREAS,the City Councilof the City of Baytown did,by Ordinance No.1256 duly enacted on the 18th day of July,1972,determine the necessity for and order the permanent improvement of certain portions of Crow Road,Mapleton Avenue,South Bayshore Drive,West Bayshore Drive,East Bayshore Drive,and Brownwood Drive in Baytown,Texas,directing the Engineer to prepare an estimate of the cost of such improvements and a written statement of owners of interest in property abutting said streets anddid provide that a partof the cost of said improvements would be paid by the City and a part of the cost of said improvements would be paid by and assessed against the abuttingproperty and the owners thereof;and WHEREAS,said City Council,after having duly advertised for bids in the manner and forthe time as required by lawandthe Charter of said City,did determine that the bid of Skrla Inc.was the lowest and best bid for the con struction ofsaid improvements;and WHEREAS,the City Council of the City of Baytown did,by Ordinance No.1266, duly enacted on the 17th day of August,1972,find and determine that apportioning the assessed portion of the cost of the project on a front footplan or rule would result in injustices and inequities,and approved and adopted the engineers statement ofcost estimates of the amounts proposed tobe assessed against the abutting property;and further,ordered and set a hearing to be held at 6:30 o'clock p.m.on the 14th day of September,1972,in its Council Chambers atthe City Hall of and in the Cityof Baytown,Texas,as to the special benefits to accrue to said abutting properties and the owners thereof by virtue of said improvements,if any,or concerning any error in validity,irregularity or de ficiency in all proceedings or contract concerning same.At which time all persons,firms,corporations,estates,owningorclaiming anysuch abutting property,their agents or attorneys,or any persons interested in said proceedings, might appear in person or by counsel and offer evidence;and j WHEREAS,by Ordinance No.1273 duly enacted on the 14th day of September, 1972,the City Council of the City of Baytown,Texas,closed the Hearing on Benefits and did levy,assess and charge a portion of the cost of the improve ments against the abutting properties andthe owners thereof and did further provide thatany mistake or error,invalidity or irregularity might be corrected; and WHEREAS,certain mistakes,errors and irregularities in the assessment roll adopted by Ordinance No.1273have come to the attention of Council;NOWTHEREFORE, BE IT ORDAINED BYTHE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1:That,the City Council of the City of Baytown finds that certain mistakes,errors,or irregularities were contained in the assessment roll as adopted by City Council in Ordinance No.1273 on September 14,1972,and said assessment roll is hereby amended as follows: Page No.6 of 25 -South Bayshore West Side Parcel No.Owner Description Nick Stabile et ux Betty J.Lot 4&5,Block A 220 Bayshore Drive Baytown,Texas77520 Remarks One Residence Exterior Page No.16 of 25 -Mapleton-South Side Parcel No. 14 Owner Allen L.Wilder and Marsha Ann Wilder 121 Mapleton Baytown,Texas 77520 Description Lot 13,Block K Wooster Remarks No Residence Page No.21 of 25 -North Bayshore South Side Parcel No. 13 Owner Gladys Booth 274 Palomares Avenue Ventura,California 93003 Description Lot 4,Block F Brownwood Subdivision of Wooster Remarks No Residence Total Assessment $250.00 Total Assessment -0- Total Assessment -0- Section 2:That this ordinance shall take effect from and after its passage by the City Council of the City of Baytown. -2- INTRODUCED,READ and PASSED by the affirmative vote of the City Council of the City of Baytown,on this the 14th day of February ,1974.
