AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
ACCEPTING THE BID OF BROWN &ROOT,INC.FOR THE CONSTRUCTION OF
THE 1974 STREET IMPROVEMENT PROGRAM AND AUTHORIZING THE CONTRACTING
OF INDEBTEDNESS BY THE CITY FOR THESUM OF ONE HUNDRED SEVENTY-
THREE THOUSAND FIVE HUNDRED SEVENTY-THREE AND 05/100 ($173,573.05)
DOLLARS WITH REGARD TOSUCH AGREEMENT.
WHEREAS,the City Council of the City of Baytown,Texas,did authorize Jack
Morton,City Engineer for the City of Baytown,to advertise for bids for the
construction of the 1974 Street Improvement Program tobe received February 12,
1974;and
WHEREAS,notice to bidders as to the time and place,when and where
the contract for said construction would be let was published pursuant to provisions
of Vernon's Civil Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City Hall at 3:00 o'clock
p.m.,Tuesday,February 12,1974,as per published notice to bidders;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1:That the City Council of theCityof Baytown,Texas,hereby
accepts the bid of Brown &Root,Inc.,according to the plans and specifications
set forth by the City Engineer on a construction timetable of seventy (70)working
days for the sum of One Hundred Seventy-Three Thousand Five Hundred Seventy-Three
and 05/100 ($173,573.05)Dollars,andthe Mayor and City Clerk of the City
are hereby authorized and directed to execute and attest to a contract with Brown &
Root,Inc.for the construction ofsaid street improvement program,containing
the plans,specifications,and requirements of the City Engineer and appropriate
bond and drawn provisions in accordance with the provisions of Vernon's Civil
Statutes,Article 5160.
Section 2:That,pursuant to the provisions of Article 2368a,Section
2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general
authority to approve any change order involving a decrease or an increase in
costs ofFive Thousand andNo/100 ($5,000.00)Dollars or less,subject to the
proviso that the original contract pricemay not be increased by more than
twenty-five (25%)percent or decreased by more than twenty-five (25%)percent
without the consentof the contractor to such decrease.
Section 3:This ordinance shall take effect from and after its passage
by the City Council of the City of Baytown.
