AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
ACCEPTINGTHE BID OFCHATHAM AND HOLZAEPFEL FOR THE DEVELOPMENT
OF PELLY PARK AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS
BY THE CITY FOR THE SUM OF TWENTY-THREE THOUSAND FIVE HUNDRED
FIFTEEN AND 80/100 ($23,515.80)DOLLARS WITH REGARD TO SUCH
ACCEPTANCE.
WHEREAS,the City Council of the City of Baytown,Texas,did authorize Busch,
Hutchison &Associates,Inc.,Consulting Engineers to the City of Baytown,to
advertise for bids for the development of Pelly Park to be received January 14,
1974;and
WHEREAS,notice to bidders as to the time and place,when and where the
contract for said construction would be letwas published pursuant to provisions
of Vernon's Civil Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City Hall as per published
notice to bidders;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF BAYTOWN:
Section 1:That the City Council of the City of Baytown,Texas,hereby
accepts the bid of Chatham and Holzaepfel according to the plans and specifications
set forth by the Consulting Engineers on a construction timetable of 120 calendar
days for the sum of Twenty-Three Thousand Five Hundred Fifteen and 80/100
($23,515.80)Dollars,and the Mayor and City Clerk of the City are hereby authorized
and directed to execute and attest to a contractwith Chatham and Holzaepfel for
the development of said park,containing the plans,specifications,and requirements
of the Consulting Engineers and appropriate bond and drawn provisions in accordance
with the provisions of Vernon's Civil Statutes,Article 5160.
Section 2:That,pursuant to the provisions of Article 2368a,Section
2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general
authority to approve any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the
proviso that the original contract price may not be increased by more than
twenty-five (25%)percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shall take effectfrom and after its passage by
the City Council of the City of Baytown.
