AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
ABANDONING A TEN (1O1)FOOT UTILITY EASEMENT OUT OF LOTS 5 AND
6 OF DANUBINA ACRES,BAYTOWN,HARRIS COUNTY,TEXAS;AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE SUCH INSTRUMENTS AS ARE NE
CESSARY FOR SUCH ABANDONMENT,IF ANY;AND PROVIDING FOR AN
EFFECTIVE DATE HEREOF.
WHEREAS,there presently exists a ten (10')foot utility easement
extending along the common lot line between Lots 5 and 6 of Danubina Acres,
Baytown,Harris County,Texas;and
WHEREAS,the owner of Lots 5 and 6 of Danubina Acres has requested abandon
ment of this easement by the City of Baytown;and
WHEREAS,the owner ofLots 5 and 6 of Danubina Acres has conveyed to the
City of Baytown a ten (101)foot utility easement along the rear portion of Lot
5,Danubina Acres in order to serve the same purposes as the easement which has
been requested to be abandoned;and
WHEREAS,the provisions of Resolution No.11 of the City Council of the
City of Baytown dated the 24th day of January,1963,have been complied with;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1:That the ten (10')foot utility easement described in Exhibit
^p»s "A"to this ordinance is hereby abandoned and the Mayor and City Clerk are hereby
authorized to execute such instruments necessary for such abandonment,if any.
Section 2:This ordinance is to become effective from and after its passage
by the City Council of the City of Baytown.
INTRODUCED,READ and PASSED by the affirmative vote of the City Council
of the City of Baytown on this13th day of December ,1973.

Field note description of a 10 ft.easement parallel to and 5 ft.
at right angles to the North boundary of Lot 5,Block 2,and parellel to
and 5 ft.at right angles to the South boundary of Lot 6,Block 2,of
Danubina Court Section One,a subdivision in the William ScottLower League,
Abstract 65,City of Baytown,Harris County,Texas,according toMap or
Plat thereof recorded in Volume 17 at Page 16 of the Map Records of Harris
County,Texas,to which reference is herein made,the following field note
description describes all of aforesaid easement parallelto the North line
of Lot 5 and the South line of Lot 6,save and except the West 1?'ft,
of said easement;
BEGINNING at a point at the East boundary of Lot 6,Block 2 and the West
right-of-way line-of State Highway-No.T.46j "(SSrth Alexander Drive),said
point described as being North 21 deg.20 min.East a distance of 5 ft.
from the Northeast corner of Lot 5 and the Southeast corner of Lot 6,
Block 2;said beginning point being at the North Boundary of said easement;
THENCE North 71 deg.00 min.West alonga line and partly across
aforesaid Lot 6,and along the North boundary of said easement*said line
parallel to and 5 ft.at right angles to the South boundary of Lot 6,a
distance of 88 ft.to the Northwest corner of tract described,said corner
described as being South 71 deg.00 min.East a distance of 12.0 ft.from
the West line of Lot 6 and the Eastline of Lot 7,Block 2;
THENCE South 21 deg.20 min.West alongthe West line of easement
described passing at 5 ft.the common dividing line of Lots 5 &6 of
Block 2,continuing along same line over and into Lot No.5 a total
distance of 10 ft.to the Southwest corner of easement described,said
corner situated at the South line of said easement;and further described
as beingSouth 71 deg.00 rain.East a distance of 12.0 ft.from the
common dividing line of Lots 4 5.5,Block 2;
THENCE South 71 deg.00 min.East along the South line of said
easement,said line parallel to and 5 ft.at right angles from the North
boundary aforesaidLot 5,a distance of 88 ft.to a point forcorner at
the West right-of-way line of State Highway 146 (North Alexander Drive)
and the East boundary of Lot 5,being the Southeast corner of easement
described;
THENCE North 21 deg.20 min.East along the West right-of-way line
of State Highway 146 (North Alexander Drive)and the East boundary of
Lots 5 and 6,passing at 5 ft.the Northeast corner of Lot 5 and the
Southeast corner of Lot 6 Block 2,continuing along same line being the
East line of Lot 6,in all a total distance of 10 ft.to the point of
beginning containing within the boundaries described (879.263 sq.ft.)
0.020 acres of land more or less.
