AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN,
TEXAS,BY THE AMENDMENT OF CHAPTER 7,"BUILDINGS",SECTION 7.2,PRO-
PROPERTY EXEMPTED FROM FIRE ZONES,TO REPEAL THE PROVISIONS OF SUCH
SECTION AS PRESENTLY CONSTITUTED AND TO SUBMIT IN ITS PLACE A NEW
SECTION 7.2,PROPERTY DELETED FROM FIRE ZONES;REPEALING ORDINANCES
INCONSISTENT HEREWITH,CONTAINING A SAVINGSCLAUSE,ANDPROVIDING
FORTHE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the City of Baytown is hereby
amended by the amendment of Chapter 7,"Buildings",by repealing Section 7.2,
(Property Exempted from Fire Zones,thereof andthe same shall cease to have force
and effect from and after the effective date of this ordinance.
Section 2:That the Code of Ordinances is hereby amended by adding thereto
a new Section 7.2,Property Deleted from Fire Zones,which shall read as follows,
to-wit:
Section 7.2.Property deleted from Fire Zones.
The following property is deleted from classification either from Fire
Zone No.One (1)or FireZone No.(2):
(a)Lot Six (6),Block Three (3)of East Baytown a subdivision in the
William Scott Upper League of Harris County,Texas.Recorded in Volume
Seven (7)-Page Fifty-four (54)with Harris County.
^(b)Lots Six (6),Seven (7),and Eight (8);Block Twenty-five (25)
f in Pruett Addition in the City of Baytown,Harris County,Texas.
(c)BEGINNING at a point on the West right of way line of Garth Road,
said point being the Eastmost corner of the Woodcreek Apartments 15.187
acre tract;
THENCE,North 45 degrees 40 minutes 57 seconds West along the Northeast
line of the Woodcreek Apartments tract approximately 204 feet to a point,
said pointbeing 200 feet perpendicularly from the West right of way line
of Garth Road;
THENCE,in a Southwesterly direction,200 feet from and parallel to the
curvature of the West right of way line of Garth Road to a point on the
South line of the Woodcreek Apartments tract;
THENCE,North 88 degrees 47 minutes 27 seconds East along the South line
of the Woodcreek Apartments tract approximately 250 feet to a point on
the West right of way line of GarthRoad;
THENCE,in a Northeasterly direction along the West right of way line of
/m.Garth Road a distance of 480.50 feet to the POINT OF BEGINNING.
Section 3:Repealing Clause:All ordinances or parts of ordinances incon
sistent with the terms of this ordinances are herebyrepealed;provided,however,
that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative ofother ordinancesregulating
and governing the subject matter covered by this ordinance.
Section 4:Savings Clause:If any provision,section,exception,sub
section,paragraph,sentence,clause or phrase of this ordinance or the application
of same to any person or set of circumstances,shall for any reason be held un
constitutional,void or invalid,such invalidity shall notaffect the validity
of the remaining provisions of this ordinance ortheir application to other persons
or sets of circumstances and to this end all provisions ofthis ordinance are de
clared to be severable.
Section 5:Effective Date:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
