AN ORDINANCE OF THE CITY COUNCIL OF THE CITYOF BAYTOWN,TEXAS,AMENDING
CHAPTER 31,"UTILITIES"ARTICLE IV,WATER SERVICE,SECTION 31-54,WATER
DEPOSITS AND REFUNDS,BY ADDING A CONCLUDING PARAGRAPH AUTHORIZING THE
UTILITY OFFICE MANAGER TO REQUIRE ADDITIONAL DEPOSITS FOR WATER SERVICE
WHEN NECESSARY TO INSURE PAYMENT AND PROVIDING FOR THE DISCONTINUANCE OF
WATER SERVICE IF SAID DEPOSIT IS NOT TENDERED WITHIN THIRTY (30)DAYS AS
PROVIDED;REPEALING ORDINANCESINCONSISTENT HEREWITH;CONTAINING A SAVINGS
CLAUSE;AND PROVIDING FORTHE PUBLICATION AND EFFECTIVE DATE HEREOF.
BEIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the City of Baytown,Texas,is
hereby amended by the amendment of Chapter 31,"Utilities",Article IV,Water
Service,Section 31-54,Water Deposits and Refunds,by adding a concluding para
graph which shall read as follows,to-wit:
Section 31-54.Water deposits and refunds.
Deposits for commercialconsumers,apartment houses,mobile parks or
other multi-family dwelling projects may be increased from time to time
if it is determined by the Utility OfficerManager that additional de
posits are necessary in order to insure payment of charges for water
service.The additional deposit shall be tendered to the Water De
partment within thirty (30)days after notice of the increase in deposit.
Provisions of Section 31-58 shall apply if said additional deposit is
not tendered within thirty (30)days.
Section 2:Repealing Clause:All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby repealed;provided,
however,that such repeal shallbe only to the extent of such inconsistency
and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
Section 3:Savings Clause:Ifany provision,section,exception,subsection,
paragraph,sentence,clause or phrase of this ordinance or the application
of same to any person or set of circumstances,shall for any reason be held
unconstitutional,void or invalid,such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and tothis end all provisions of this ordinance
are declared tobe severable.

Section 4:Effective Date:This ordinance shall take effect from and
after ten (10)days from its passage by the City Council.The City Clerk is
hereby directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at leasttwice
within ten days after the passage of this ordinance.
