AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,DE
SIGNATING CERTAIN AREAS AS NO-PARKING ZONES AS PROVIDED BY SECTION
18-122 OFTHE CODE OF ORDINANCES;REPEALING ORDINANCES INCONSISTENT
HEREWITH;CONTAINING A SAVINGS CLAUSE;PRESCRIBING A MAXIMUM PENALTY
OF TWO HUNDRED ($200.00)DOLLARS FOR EACH VIOLATION;ANDPROVIDING
FORTHE PUBLICATION AND EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:Pursuant to the provisions of Section 18-122 of the Code of
Ordinances,the following described portions of Defee and Sterling Streets are
hereby declared to be no-parking zones,and parking of vehicles of any nature
within such areas or zones shall be prohibited as follows:
Section 18-122.2 -Designation of no-parking zones.
(a)The south side of Defee Street from North Main to Alexander
Drive (State Highway 146).
(b)The north side of Defee Street from North Seventh Street to
Alexander Drive (State Highway 146).
(c)The north side ofSterling Street from Commerce Street to
Whiting Street.
Section 2:Repealing Clause:All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby repealed;provided,
however,that such repeal shall be only to the extent of such inconsistency
andin all other respects this ordinance shallbe cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
Section 3:Savings Clause:If any provision,section,exception,
subsection,paragraph,sentence,clause or phrase of this ordinance or the
application of same to anyperson or set of circumstances,shall forany reason
be held unconstitutional,void or invalid,such invalidity shall not affect
the validity of the remaining provisions of this ordinance or their application
to other persons orsets of circumstances and to this end all provisions of
this ordinance are declared to be severable.
Section 4:Penalty Clause:Any person who shall violate any provision
of this ordinance shall be deemed guilty of a misdemeanor and upon conviction
shall be punished by a fine of not less than Ten ($10.00)Dollars,nor more
than Two Hundred ($200.00)Dollars.Each day of the continuance ofsuch vi
olation shall be considered a separate offense and each and every dayshall
constitute a separate violation.
Section 5:Effective Date:This ordinance shall take effectfrom
and after ten (10)days from its passage by the City Council.The City Clerk
is hereby directed to give noticehereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at least twice
within ten days after the passage of this ordinance.
