Ordinance No. 1,475ORDINANCE NO.1475 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,PROVIDING FOR THE REMOVAL OF STOPSIGNS AT CERTAIN INTERSECTIONS AND THE POSTING OF STOP SIGNS AT CERTAIN INTERSECTIONS IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 18,"MOTOR VEHICLES AND TRAFFIC",SECTION 18-70,THROUGH STREETS; REPEALING ORDINANCES INCONSISTENT HEREWITH;CONTAINING ASAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00)DOLLARS FOR EACH VIOLATION;AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:Pursuant to the provisions of Section 18-70 of the Code of Ordinances,the following described intersections are declared to be stop in tersections: North Whiting Street at its intersection with West Defee Avenue North Whiting Street at its intersection with WestSterling Avenue North Commerce Street at its intersection withWest Sterling Avenue North First Street atits intersection with East Defee Avenue North Second Street at its intersection withEast Sterling Avenue North Third Street at its intersection withEast Sterling Avenue North Fourth Street at its intersection withEast SterlingAvenue North Fourth Street at its intersection with East Defee Avenue North Fifth Street at its intersection with East SterlingAvenue North Fifth Street at its intersection with East Defee Avenue North Sixth Street at its intersection with East SterlingAvenue North Seventh Street at its intersection with East Defee Avenue North Seventh Street at its intersection withEast Sterling Avenue Lafayette Drive at its intersection with East Defee Avenue Highway Boulevard at its intersection with East Defee Avenue Section 2:The Chief of Police is authorized and directed to cause the proper signs to be posted at the above described locations. Section 3:Pursuant to the provisions of Section 18-70 of the Code of Ordinances,the followingdescribed intersections will no longer bestop in tersections: East Defee Avenue at its intersection with North Seventh Street East Defee Avenue at its intersection with North Fourth Street East Defee Avenue at its intersection with North First Street West Defee Avenue at its intersection with Felton Street West Sterling Avenue at its intersection with Felton Street Section 4:The Chief of Police is authorized and directed to cause the removal of stop signs at the intersections listed in Section 3 above. Section 5:Repealing Clause:All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed;provided, however,that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulativeof other ordinances regulating and governing the subject matter covered by this ordinance. Section 6:Savings Clause:If any provision,section,exception, subsection,paragraph,sentence,clause or phrase of this ordinance or the application of same to any person or set of circumstances,shall for any reason be held unconstitutional,void or invalid,such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 7:Penalty Clause:Any person who shall violate any provision of this ordinance shall be deemed guiltyof a misdemeanor and upon conviction shall be punished by a fineof not less than Ten ($10.00)Dollars,nor more than Two Hundred ($200.00)Dollars.Each day of the continuance of such vi olation shall be considered a separate offense and each and every day shall constitute a separate violation. Section 8:Effective Date:This ordinance shall take effect from and after ten (10)days from its passage by the City Council.TheCityClerk is hereby directed to givenotice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten days after the passage of this ordinance.
