AN ORDINANCE OFTHE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY
OF BAYTOWN TO EXECUTE AND ATTESTTO A CONTRACT WITHTHE HOUSTON-
GAL VESTON AREA COUNCIL FOR THE PURCHASE OF POLICE RADIO EQUIPMENT
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF BAYTOWN,TEXAS:
Section 1:That the City Council of the City of Baytown,Texas,hereby
directs the Mayor and City Clerk of the City of Baytown to execute and attest
to a contract between the City of Baytown and the Houston-Galveston Area Council
forthe purchase of police radioequipment.A copy ofsaid contract is attached
hereto,marked Exhibit "A",and made a part hereoffor all intents and purposes.
Section 2:This ordinance shall take effect from and after its passage
bythe City Council of the City of Baytown.

IV.
The City,after acceptance of a bid,and the execution of a purchase con
tract by the Council,agrees to furnish to the Council,upon its request,a cash
amount in the statutory amount required by the Texas Criminal Justice Council and
the Houston-Galveston Area Council.
V.
This agreement shall take effect upon execution by the signatories.
VI.
This agreement shall continue in effect from the date of execution until
completion of the installation of said radio equipment into the facilities of the
City.
VII.
Upon completion of equipment installation,and certification by the
Council's consultant,and the Texas Criminal Justice Council,that all conditions
and specifications of the H-GAC Regional Law Enforcement Radio Communications
Detailed Design have been met,the Council agrees to convey fee simple title to
the Cityfor all equipment purchased using City funds.
VIII.
The City further certifies that:
No other equipment owned by the City is available for the project.
Grant funds will not be used to provide reimbursement for the purchase
price of equipment already owned by the City,except through permissible de
preciation or use allowance actually charged to the City.
If equipment is used for purposes other than this project,the appropriate
proration of costs to each activity involved will be effected.
Allowability of the cost of equipment purchased with federal funds will
be reduced tothe extent ofresale or recovery value where use ofsuch equipment
for carrying out the purposes of the grant project is discontinued (during the
life of the project)or usefor law enforcement purposes is discontinued (after
completion of the project)unless all creditrelating to such contingencies as
set forth is Section C3 of Circular A-87,"Applicable Credit",are applied to •

offset or reduce grant charges.Circular A-37 is reprinted in the appendixes
section of the Texas Criminal Justice Council publication "Policies and Procedures
Governing Action Grants".
In compliance with the requirement that federal funds made available
under Part C,Title 1,Public Law90-351,as amended,be used so as "not to sup
plantstate or local funds,"this is to certify that the below described reci
pient of federal funds under Part C,Title 1,Public Law 90-351,as amended,will
use such funds to increase state or local funds that would,in the absence of such
federal aid,be made available for law enforcement purposes.
The equipment distributed or to be distributed has been or will be properly
recorded on the property records of the City.
IN WITNESS WHEREOF,the parties hereto have caused this agreement tobe
executed by their authorized officers theday and year first above written.
