Ordinance No. 1,452ORDINANCE NO.1452 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, ACCEPTING THE COMPREHENSIVE DRAINAGE STUDY PERFORMED BY BERNARD JOHNSON INCORPORATED,FINDING THAT THE STUDY IS ACCEPTABLE AND AUTHORIZING FINAL PAYMENT IN THE AMOUNTOF SEVEN THOUSAND FIVE HUNDRED ANDNO/100 ($7,500.00)DOLLARS TO BERNARD JOHNSON INCOR PORATED AS THE CITY OF BAYTOWN'S PORTION OF THE AMOUNT DUE AND UNPAID ON THE CONTRACT,SAID PAYMENT TO BE CONTINGENT UPON RE CEIPT OF CERTIFICATION OF FINAL ACCEPTANCE BY THE DISTRICT'S ENGINEER AND RECEIPT OF THE DISTRICT'S PORTION OF THE FINAL PAYMENT AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS,the City of Baytown heretofore contracted with BernardJohnson Incorporated for a comprehensive drainage study of the City of Baytown and ad jacent portionsof Harris County for the sum of Ninety Thousand and No/100 ($90,000.00)Dollars;Forty-Five Thousand and No/100 ($45,000.00)Dollars as the City's share and Forty-Five Thousand and No/100 ($45,000.00)Dollars as Harris County Flood Control District's share;and WHEREAS,the Comprehensive Drainage Study has been completed and the City and District have received the printed and bound drainage plans prepared by BernardJohnson Incorporated;and WHEREAS,pursuant to the terms of the contract,final payment by the City for the study is to be made after the Engineer for the District is satisfied that the Comprehensive Drainage Study has been completed in accordance with the terms of the contract and has so advised the Director of Public Works by written certification of acceptance and the District has paid tothe City its portion of thecosts;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council hereby finds that the study made by Bernard Johnson Incorporated has been performed in accordancewith the terms and conditions of the contract and does herebyaccept said study. Section 2:That upon receipt of a Certificate of Acceptance from Harris County Flood Control District's Engineer andHarris County Flood Control District's share of the amount due and owing to Bernard Johnson Incorporated as final pay ment forthe Comprehensive Drainage Study,the City Council authorizes payment to BernardJohnson Incorporated of Seven Thousand Five Hundred and No/100 ($7,500.00)Dollars as theCity's portion thereof. $ Section 3:This ordinance shall take effect from and afters its passage by the City Council of the Cityof Baytown,Texas.
