Ordinance No. 1,439ORDINANCE NO.1439 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, AUTHORIZING THE PURCHASE OF 0.604 ACRES,MORE OR LESS,ON MASSEY TOMPKINS ROAD ANDCHAPARRAL DRIVE FROM ZORA MCNULTY DECKARD TO BE UTILIZED AS THE SITE FOR A FIRE STATION,AND AUTHORIZING PAY MENT TO ZORA MCNULTYDECKARD BY THE CITYOF BAYTOWN FOR THE SUM OF THIRTEEN THOUSAND AND NO/100 ($13,000.00)DOLLARS AND CERTAIN OTHER CONSIDERATIONS WHICH SHALL BE LISTED IN THE ENACTING CLAUSES OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the City of Baytown hereby authorizes the purchase of 0.604 acres,more or less,on Massey Tompkins Road and Chaparral Drive from Zora McNultyDeckard to be utilized as the site for a fire station, said property being more particularly described as follows,to-wit: BEING a tract orparcelof land out of the J.W.Singleton Survey,A-809,and being part of that certain one (1)acre tract of land conveyed to E.E.McNulty and wife,Zora McNulty by deeds recorded in Volume 1265,at Page 452 of the Harris County Deed Records,and being part of that certain 1-acre tract conveyed to E.E.McNulty and wife Zora McNulty by Deed records in Volume 1296 at Page 451 of the Harris County Deed Records and being part of that certain 1-acre tract con veyed to E.E.McNulty and wife Zora McNulty by Deed Recorded in Volume 1740,at Page 287,of the Harris County Deed Records,Harris County,Texas and being more particularly described by metes and bounds as follows: BEGINNING at the intersection of the East right of way line of Chaparral Drive (former Barkuloo Road Number 2)andthe North right of way line of Massey Tompkins Road; THENCE,from the POINT OF BEGINNING,North 81°10'27"East with the North right of way line of Massey Tompkins Road andthe South line of this tract, a distance of 158.66 feet to a point; THENCE,North 11°27'28M West with the East line of a 1-acre tract as re ferenced by Deed recorded in Volume 1740,at Page 287 of the Harris County Deed Records,a distance of 167.90 feet to a point situated in the East right of way line of Chaparral Drive; THENCE,South 79°54'22"West with the North line of this tract,over and across the above referrenced tracts,a distanceof 158.54 feet to a point situated in the East right of way line of Chaparral Drive; THENCE,South 11O27'28"East with the East right of way line of Chaparral Drive,a distance of164.38 feet to the POINT'OF BEGINNING,enclosing a tract of land containing 0.604 acres,more or less. Section 2:That the City Council of the City of Baytown hereby authorizes the purchase of the above referred to property for the sum of Thirteen Thousand and No/100 ($13,000.00)Dollars conditioned upon the following: 1.That the sewer and water be made available to a house at 3800 Chaparral Drive with the owner paying only the custo mary tap fees. 2.That the City annex this property. 3.Closing costs except Title Policy are to be borne by the City. Section 3:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
