AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN,
TEXAS BY THE AMENDMENT OF CHAPTER 12,"FIRE PREVENTION ANDPROTECTION",
ARTICLE IV,FIRELANE EASEMENT,SECTION 12-48.5,DEDICATIONS AND
CERTIFICATIONS,BY THE ADDITION OF NEW SUBSECTIONS 1 AND 2,REPEALING
ORDINANCES INCONSISTENT HEREWITH;CONTAINING A SAVINGS CLAUSE;AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the City of Baytown,Texas,is
hereby amended by amending Chapter 12,"Fire Prevention and Protection",Article
IV,Fire Lane Easement,Section 12-48.5,Dedications and Certifications,by the
addition ofnew Subsections (1)and (2)which shall read as follows,to-wit:
Section 12-48.5 DEDICATIONS AND CERTIFICATIONS
The dedications and certifications shall conform to the following form.
Lienholders must join the dedications.
(1)Dedication for Individuals

I,(or We),(Name of owner or owners),owner (or owners)of the (acres)-
tract of land in the (name of survey and abstract number),City of Baytown,
Harris County,Texas,as shown on the attached map or plat of (name of project),
certify to the following:
The attached map or plat truly and correctly represents the proposed
plan and type of development of that certain (acres)-tract of land.
It is desired and intended to establish as fireland easements,all
the area shown thereon as a fire lane easement,and I (or we)hereby
covenant and restrict the land within this plat to the uses as shown
on the plat,and no use of such land,different from that shown on the
recorded plat,shall be made unless and until all ordinance requirements
ofthe Cityof Baytown and the laws of the State of Texas applicable to
such proposed new uses shall have first been complied with.
Upon approval of the attached mapor plat by the Planning Commission,
the undersigned (name of owner or owners),my (our)successors and
assigns,will forever keep and permit to be keptopen,the area thereon
shown as a fire lane easement unless the Planning Commissionor the City
Council of the City of Baytown shall thereafter permit and authorize the

Section 2:Repealing Clause:All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby repealed;provided,
however,that such repeal shall be only to the extent of such inconsistency
and in all other respects this ordinance shall be cumulative of other ordi
nances regulating and governing the subject matter covered by this ordinance.
Section 3:Savings Clause:If any provision,section,exception,
subsection,paragraph,sentence,clause or phrase of this ordinance or the
application of same to any person or set of circumstances,shall for any
reason be held unconstitutional,void or invalid,such invalidity shall not
affect the validityof the remaining provisions of this ordinance or their
application to other persons or setsof circumstances and tothis end all
provisions of this ordinance are declared tobe severable.
Section 4:Effective Date:This ordinance shall take effect from
and after its passage by the City Council of the City of Baytown.
