Ordinance No. 1,398® ORDINANCE NO. 1398 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF.BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A LEASE AGREEMENT WITH ARMANDO SALINAS AND VINCENT CANALES AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the Mayor and City Clerk of the City of Baytown to execute and attest to a Lease Agreement for park purposes with Armando Salinas and Vincent ® Canales,.a copy of said Lease Agreement marked Exhibit "A" attached hereto and made a. part hereof. Section 2: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown., INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown this 26th day of April , 1973. WITNESSETH: WHEREAS, the City of Baytown desires to lease the property owned by Armando Salinas and Vincent Canales located in said City for park purposes; and WHEREAS, Armando Salinas and Vincent Canales desire to lease said property to said City; NOW THEREFORE, Lessor, for and in consideration of the covenants and agreements hereinafter .mentioned, to be kept and performed by Lessee, has demised and leased to Lessee all those premises located in Baytown, Harris County, Texas, known and described as follows, to -wit: Lots Twenty -Six (26), Twenty -Eight (28), Thirty (30), Thirty -Two (32) and Thirty -Four (34) of Rio Vista Addition, a subdivision in Baytown, Harris County, Texas, according to Map or Plat thereof recorded in Volume 998, Page 492 of the Deed Records of Harris County, Texas. 0 That Lessor has agreed to let, and hereby does let, to Lessee, and Lessee has agreed to take, and hereby does take, from Lessor, commence on the lst day of May, 1973, and to end g if requested by Lessee, will grant a further lease said Lessee for a further term of one (1) year, to the term hereby, granted, at the same yearly rental like those in these presents contained. II. .for a term of one (1) year, to i the 1st day of May, 1974. Lessor, of the aforesaid premises to the commence from the expiration of and containing covenants therein That Lessee will pay Lessor the sum of One ($1.00) Dollar per year for the use of said premises. III. That Lessee may occupy said premises for official city purposes and may erect, build and place on same, facilities for a park to be enjoyed by the citizens of the City of Baytown, and the said Lessor agrees that Lessee shall peaceably possess the said premises, during said term, without the lawful interruption of any person what- soever. U n a IV. It is understood and agreed that Lessee shall be responsible for all such fa- cilities placed on said premises and shall keep and save harmless Lessor from any and all liability which may arise from the use of said facilities. V. It is further understood and agreed that all property erected on said leased premises may be removed by Lessee at the termination of this lease, or any extension thereof, and on termination of this lease shall return said premises in a condition equal to or better than the condition as of the date hereof. Vi. It is further understood and agreed that as additional consideration for the ex- ecution of this lease, Lessee will pay all Ad Valorem taxes assessed by all taxing .Surisdiction upon the hereinabove referred to property before said Ad Valorem taxes may become delinquent.
