Ordinance No. 1,384ORDINANCE NO. 1384 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PURCHASE OF A PERMANENT EASEMENT 20 FEET IN WIDTH AND A TEMPORARY CONSTRUCTION EASEMENT 30 FEET IN WIDTH OVER AND ACROSS A 3.5 ACRE TRACT OF LAND OWNED BY H. H. TOWNSEND, JR. AND AUTHORIZING PAYMENT TO H. H. TOWNSEND, JR. BY THE CITY OF BAYTOWN OF THE SUM OF ONE THOUSAND FOUR HUNDRED NINETY AND 121100 ($1,490.72) DOLLARS, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the purchase of a permanent easement 20 feet in width and a temporary construction easement 30 feet in width over and across a 3.5 acre tract of land owned by H. H. Townsend, Jr., being particularly described as follows, to -wit: BEING a 20 foot permanent utility easement out of the 3.5 acre tract of land conveyed as Tract 1 and Tract II to H. H. Townsend, Jr., by Pace Setter Homes, Inc., in Volume 6550, Page 495 of the Deed Records of Harris County, Texas, said tract of land being located in the Harvey Whiting Survey, Abstract 840, Harris County, Texas, and being more particularly described by metes and bounds as follows: TRACT 1 BEGINNING at the Northwest property corner of the aforementioned H. H. Townsend, Jr., tract; said corner being in the South right -of -way line of Park Street; THENCE, South I degree, 21 minutes East, a distance of 173.30 feet to a point for the Southwest corner of the herein described permanent utility easement; THENCE, North 88 degrees, 39 minutes East a distance of 20.00 feet to a point for the Southeast corner of the herein described permanent utility easement; THENCE, North T degree, 21 minutes West, a distance of 181.18 feet to a point in the South right -of -way line of Park Street for the Northeast corner of the herein described permanent utility easement; THENCE, South 65 degrees, 06 minutes West a distance of 10.52 feet to a point; THENCE, South 69 degrees, 06 minutes West, a distance of 10.99 feet to the POINT OF BEGINNING containing 0.1019 acres, more or less. TRACT II BEGINNING, at the Southwest corner of the aforementioned Tract I permanent utility easement; said corner being the Northwest corner of the herein described permanent utiTfty easement; THENCE, South 01 degree, 21 minutes East a distance of 45.00 feet to a point for the Southwest corner of the herein described permanent utility easement; THENCE, North 88 degrees, 39 minutes East, a distance of 20.00 feet to a point for the Southeast corner of the herein described permanent utility easement; THENCE, North 01 degree, 21 minutes West a distance of 45.00 feet to a point for the Northeast corner of the herein described permanent easement; said point also being the Southeast corner of the aforementioned Tract I permanent utility easement; THENCE, South 88 degrees, 39 minutes West a distance of 20.00 feet to the POINT OF BEGINNING containing 0.0207 acres of land, more or less. TEMPORARY CONSTRUCTION EASEMENT A 30 -foot temporary construction easement with a centerline parallel to the Easterly side of the aforementioned 20 -foot utility easements, and 15 -feet distance at right angle to the Easterly side of the aforementioned 20 -foot utility easements. and authorizes payment to H. H. Townsend, Jr. by the City of Baytown of the sum of One Thousand Four Hundred Ninety and 12/100 ($1,490.12) Dollars. Section 2: This ordinance shall take effect immediately upon its passage by the City Council of the City of Baytown.
