Ordinance No. 1,382ORDINANCE NO. 1382 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE CITY OF BAYTOWN TO EXECUTE A CONTRACT WITH THE BAYTOWN LITTLE LEAGUES WITH REGARD TO SUPERVISION OF THE LITTLE LEAGUE PROGRAM IN THE CITY OF BAYTOWN AND AUTHORIZING PAYMENT BY THE CITY OF TWO THOUSAND ONE HUNDRED AND NO /100 ($2,100.00) DOLLARS WITH REGARD TO SUCH AGREEMENT; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: SECTION 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager of the City of Baytown to execute a contract with the Baytown Little Leagues for the payment by the City of Baytown of the sum of Two Thousand One Hundred and No /100 ($2,100.00) Dollars for service to be rendered in the supervision and management of the Little League Program in the City of Baytown, Texas. SECTION 2: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown. GLEN WALKER, Mayor ATTEST: EDNA OLIVER, City Clerk APPROVED: z'l T i,U NEEL RICHARDSON, City Attorney E X H I B I T "A" THE STATE OF TEXAS I COUNTY OF HARRIS I WHEREAS, the Baytown Little Leagues presently administer and supervise the Little League Program in the City of Baytown; and WHEREAS, the City Council of the City of Baytown recognizes that Little League Baseball is a recreational activity which would normally come within the purview of the Parks & Recreation Department of the City of Baytown; and WHEREAS, due to the experience of the Baytown Little Leagues in the supervision and management of this program, the City Council of the City of Baytown is of the opinion that the interest of the citizens of Baytown in general and the participants in these activities in particular would best be served by the continued administration and supervision of this program by the Baytown Little Leagues; NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS: THAT, the City of Baytown, a body corporate and politic under the laws of the State of Texas hereinafter sometimes called "City" and the Baytown Little Leagues agree as follows: 1. That, the City agrees to pay to the Baytown Little Leagues the sum of Two Thousand One Hundred and No /100 ($2,100.00) Dollars for service to be rendered in the supervision and management of the Little League Program in the City of Baytown, Texas. 2. That, the Baytown Little Leagues for and in consideration of the sum of Two Thousand One Hundred and No /100 ($2,100.00) Dollars agree to do all things necessary to manage and administer the Little League Program in the City of Baytown including, but not limited to the purchase of necessary equipment, soliciting and obtaining sponsors for teams, if necessary, soliciting and directing managers of teams and leagues, maintaining playing fields, providing officiating personnel and the performance of all other acts necessary to insure a successful Little League Baseball Program in the City of Baytown, Texas. 3. That in no event will the City of Baytown pay more than Two Thousand One Hundred and No /100 ($2,100.00) Dollars toward the successful operation of Little League Baseball, and the City will not be required to undertake any ministerial functions. 4. That the City of Batown will not assume any responsibility for the Supervision and administration of the Baytown Little Leagues Program nor assume any liability arising thereunder.
