Ordinance No. 1,373ORDINANCE NO. 1373 AN ORDINANCE REGULATING THE RATES OF UNITED GAS, INC. IN THE CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYT0WN: Section 1: The following rates and charges are hereby fixed as the maximum monthly net rates and charges, and are hereby authorized for distribution and sale of natural gas in the City of Baytown, Texas, to be applied and used by United Gas, Inc. (the "Company "), its successors or assigns. RESIDENTIAL RATE Net Monthly Rate: 1. For the billing months of May through October: $2.00 per month, which includes the use of 12.3¢ per 100 cubic feet for the next 11.01 per 100 cubic feet for the next 4.2t per 100 cubic feet for all additional gas used. Minimum Bill: $2.00 2. For the billing months of November through April: $2.00 per month, which includes the use of 12.3¢ per 100 cubic feet for the next 11.0¢ per 100 cubic feet for the next 9.0� per 100 cubic feet for the next 5.5� per 100 cubic feet for all additional gas used. Minimum Bill: $2.00 400 cubic feet 2,600 cubic feet 3,000 cubic feet 400 cubic feet 2,600 cubic feet 3,000 cubic feet 10,000 cubic feet Each monthly residential bill shall be increased by the lesser of (a) 10% of the net monthly bill or (b) $3.00, to arrive at the gross monthly bill. The difference between the gross bill and the net bill, representing a discount, shall be allowed for payment of bills within ten (10) days after the date of the bill. If a gas bill is not paid within ten (10) days after its date, the gross bill shall apply. COMMERCIAL RATE Net Monthly Rate: $2.25 per month, which includes the use of 400 cubic feet 13.3¢ per 100 cubic feet for the next 8,600 cubic feet 11.0¢ per 100 cubic feet for the next 11,000 cubic feet 7.5� per 100 cubic feet for the next 10,000 cubic feet 6.O¢ per 100 cubic feet for all additional gas used. Minimum Bill: $2.25 Each monthly commercial bill shall be increased by the lesser of (a) 10% of the net monthly bill or (b) $5.00, to arrive at the gross monthly bill. The difference between the gross bill and the net bill, representing a discount, shall be allowed for payment of bills within ten (10) days after the date of the bill. If a gas bill is not paid within ten (10) days after its date, the gross bill shall apply. The rates hereinabove set out shall be effective and applicable to distribution and sale of natural gas billed with the effective date of this ordinance, unless and until such rate shall be changed hereafter in accordance with law. Section 2: The Company shall establish and post in its office rate schedules providing monthly billing rates complying with Section 1 of this ordinance and may, in addition, establish special contract rate schedules for larger volume commercial or industrial use providing other rates and charges. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, exception, section, subsection, paragraph, sen- tence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or in- valid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect immediately upon passage by the City Council of the City of Baytown. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published at least twice within ten (10) days after the passage of this ordinance.
