Ordinance No. 1,372ORDINANCE NO. 1372 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING APPRAISALS AS PRESENTED BY CARTER H. MILLER AND OTIS GRAHAM FOR ACQUISITION OF RIGHT OF WAY ON MASSEY- TOMPKINS ROAD IN THE CITY OF BAYTOWN; AUTHORIZING NEGOTIATIONS FOR ACQUISITION OF RIGHT OF WAY BASED ON THE LOWER OF THE TWO APPRAISED VALUES OF SAID PARCEL OR PARCELS; AND AUTHORIZING PURCHASE OF THE PARCEL OR PARCELS AT A PRICE NOT TO EXCEED THE AMOUNT OF THE LOWER OF THE TWO APPROVED APPRAISALS AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of Baytown has authorized the improve- ment of Massey - Tompkins Road in the City of Baytown; and WHEREAS, the City Council has authorized Carter H. Miller and Otis Graham, Realtors, to make appraisals for acquisition of right of way for the improvement of Massey - Tompkins Road in the City of Baytown; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council hereby accepts and approves the appraisals as presented by Carter H. Miller for acquisition of right of way on Massey - Tompkins Road in the City of Baytown and authorizes negotiations for acquisition of right of way based on the appraised value of said parcel or parcels, and authorizes purchase of the parcel or parcels at a price not to exceed the amount of the approved ap- praisals as follows, to -wit: OWNER Troxel1 Hart Faught Aylor & Gunn APPRAISED VALUE $13,716.00 740.00 456.00 12,647.00 Section 2: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown. The City Council of the City of Baytown, Texas, convened in Re_ gular Meeting on the 22nd day of February, 1973, in the City Hall, within said City, and the roll was called of the duly constituted officers and members of said City Council, to -wit: Glen Walker Mayor Charles Pool Councilman Charley 0. Walker Councilman Tom Gentry Councilman Allen Cannon Councilman Jody Lander Councilman Jim McWilliams Councilman Edna Oliver City Clerk and all of said persons were present except the following absentees: Councilman Jim McWilliams and Edna Oliver City Clerk , thus constituting a quorum. Whereupon, among other business, the following was trans- acted at said meeting: a written ORDINANCE APPROVING CLAIM AND AUTHORIZING DELIVERY OF CERTIFICATES OF OBLIGATION was duly introduced for the consideration of said City Council and read in full. After due discussion, it was then duly moved and seconded that said ordinance be adopted; and said motion carried by the following vote: AYES: All members of said City Council shown present above voted F None. 2. That a true, full, and correct copy of the aforesaid ordinance adopted at the meeting described in the above and foregoing paragraph is attached to and follows this certificate; that said ordinance has been duly recorded in said City Council's minutes of said meeting; that the persons named in the above and fore- going paragraph are the duly chosen, qualified, and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sufficiently notified officially and personally in advance, of the time, place, and purpose of the aforesaid meeting, and that said ordinance would be introduced and considered for adoption at said meeting; that said meeting was open to the public as required by law; and that public notice of the time, place, and subject of said meeting was given as required by Article 6252 -17, Vernon's Texas Civil Statutes, as amended. 3. The Mayor of said City has approved, and hereby approves, the aforesaid ordinance: the Mayor and the City Clerk of said City have duly signed said ordi- nance; and the Mayor and City Clerk of said City hereby declare that their signing of this certificate shall also constitute the signing of the attached and following copy of said ordinance for all purposes.
