Ordinance No. 1,356ORDINANCE NO. 1356 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 7, "BUILDINGS ", BY AMENDING ARTICLE I, IN GENERAL, SECTION 7 -1 THEREOF, SO AS TO REPEAL THE PROVISIONS OF SUCH SECTION AS PRESENTLY CONSTITUTED, AND TO SUBSTITUTE IN ITS PLACE NEW PROVISIONS, REPEALING ORDINANCES INCONSISTENT HEREWITH: CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 7, "Buildings ", by amending Article I, In General, by repealing Section 7 -1 thereof, and the same shall cease to have force and effect from and after the effective date of this ordinance. Section 2: That the Code of Ordinances, herein is hereby amended by adding thereto a new Section 7 -1 in Chapter 7, Article I, which shall read as follows, to -wi t: ARTICLE I. IN GENERAL Section 7 -1. Fire limits described. The City is hereby divided into two (2) fire zones which shall constitute the fire limits of the City. The fire zones may also be known as fire limit areas and as herein described: Fire Zone No. 1. BEGINNING at the point of intersection of the North right -of -way line of East Gulf Avenue with the West right -of -way line of South First Street; THENCE, in a Northerly direction along the said West right -of -way line of South First Street to the point of intersection of said line with the North right -of -way line of East Texas Avenue; THENCE, in a Northerly direction along the West right -of -way line of North First Street to the point of intersection of said line with the South right -of -way line of East Wright Avenue, for corner; THENCE, in a Westerly direction along the South right -of -way line of East Wright Avenue 150 feet to the Northwest corner of Lot 4, Block 4, Thomas Wright Addition; THENCE, at right angles in a Northerly direction parallel with the West boundary line of North First Street to the point of intersection of said line with the South right --of -way line of East James Avenue, for corner; THENCE, in a Westerly direction along the South right -of -way line of East James Avenue to the point of intersection of said line with the West right -of -way line of North Commerce Street; THENCE, in a Westerly direction along the South right -of -way line of West James Avenue 100 feet to the Northwest corner of Lot 8, Block 2, Pruett Addition, for corner; THENCE, at right angles in a Southerly direction parallel with the West right -of -way line of North Commerce Street to the intersection of said line with a line which is located 100 feet South and parallel to the South right -of -way line of West Sterling Avenue, which point is the Southeast corner of Lot 20, Block 8 of the Pruett Addition; THENCE, at right angles in a Westerly direction along said line located 100 feet distant from and parallel to the South right -of -way line of West Sterling Avenue to the point of intersection of said line with the East rigth -of -way line of Decker Drive; THENCE, with a Westerly extension of said line located 100 feet South of and parallel to the South right -of -way line of West Sterling to the point of intersection with right -of -way line of Decker Drive; THENCE, in a Southerly direction along the West right -of -way line of Decker Drive following its curvature to its point of intersection with the North right -of -way line of West Texas Avenue Extension; THENCE, in a Southwesterly direction along the North right -of -way line of Market Street Road to the intersection of said line with the Northerly extension of a line bearing North 12 degrees 05 minutes West, described in deed from Mrs. Georgia Pruett, et al, to the City of Goose Creek for street purposes dated December 11, 1944, reference to which is here made; THENCE, in a Southeasterly direction along the extension of said last described line and along said line to the North right -of -way line of West Gulf Avenue extended; THENCE, along the North right -of -way line of West Gulf Avenue extended in an Easterly direction to the Southeast corner of a 4.09 acre tract of land out of the Price Pruett 204.63 acre tract in the Harvey Whiting Survey conveyed to Sears, Roebuck & Company; THENCE, along the East line of said 4.08 acre tract of land owned by Sears, Roebuck & Company to its point of intersection with the North right -of -way line of West Pearce Avenue extended; THENCE, along the North right -of -way line of West Pearce Avenue extended in an Easterly direction and continuing along the said North right -of -way Tine of West Pearce Avenue to its point of intersection with the West right -of -way line of South Commerce Street; THENCE, in a Southerly direction along the West right -of -way line of South Commerce Street to the intersection of said line with the North right -of- way line of West Gulf Avenue, for corner; THENCE, at right angles in an Easterly direction along the North right - of -way line of West Gulf Avenue extended to the point of intersection of said line with the East right -of -way line of South Commerce Street being the Southwest corner of T. & N. 0. Railway Company property; -2- THENCE, in an Easterly direction along the North right -of -way line of East Gulf Avenue to the Place of Beginning. Eire Zone No. 2 shall consist of the following three (3) areas herein referred to as (A), (B) and (C). (A) BEGINNING at a point on the North right -of -way line of West Main Street, said point being the Southwest corner of Tract 53 -B, William Scott Survey, A -66, occupied by Britton - Cravens Lumber Company; THENCE, North 34 degrees 30 minutes East along the West line of Tract 53 -B a distance of 153.16 feet to a point; THENCE, South 19 degrees 56 minutes East a distance of 84.46 feet to a point, said point being 150 feet, measured perpendicularly, from the South right -of -way line of Market Street; THENCE, in an Easterly direction along a line which is located 150 feet South of, and parallel to, the South right -of -way line of Market Street to the point of intersection of said line with a line bearing North 12 degrees 05 minutes West described in right -of -way deed from Mrs. Georgia Pruett, et al, to City of Goose Creek, dated December 11, 1944; THENCE, in a Northwesterly direction along said last described line and its extension thereof to the point of intersection of said line, as ex- tended, with the North right -of -way line of Market Street; THENCE, along the North right -of -way line of Market Street with its cur- vature in an Easterly direction to the point of intersection of said line with the North right -of -way line of West Texas Avenue Extension; THENCE, in a Northerly direction along the West right -of -way line of Decker Drive with its curvature to the point of intersection of said line with the Westerly extension of a line which is located 100 feet South of, and parallel to, the South right -of -way line of West Sterling; THENCE, in an Easterly direction along the said Westerly extension of a line which is located 100 feet South of, and parallel to, the South right - of -way line of West Sterling Street to a point East of the Northeast right - of -way line of Decker Drive at a distance of 200 feet perpendicularly from the Northeast right -of -way line of Decker Drive; THENCE, in a Northwest direction parallel to, and at all points a distance of 200 feet from, the Northeast right -of -way line of Decker Drive to a point 200 feet Southeast of the Southeast right -of -way line of Garth Road; THENCE, in a Northeasterly direction 200' from and parallel to the curvature of Garth Road to a point in the south right -of -way line of Park Street; THENCE, in a Northeasterly direction to a point, being the Southeast corner of Lot 3, Block 26, Morrell Park Subdivision; THENCE, in a Northeast direction to a point, being the Northeast corner of Lot 3, Block 26, Morrell Park Subdivision; THENCE, in a Northeasterly direction to a point, being the Southeast corner of Lot 15, Block 11, Morrell Park Subdivision; THENCE, in a northeasterly direction to a point, being the northeast corner of Lot 3, Block 11, Morrell Park Subdivision; -3- THENCE, in a northeasterly direction to a point, being the southeast corner of Lot 15, Block 8, Morrell Park Subdivision; THENCE, in a northeasterly direction to a point, being the northeast corner of Lot 3, Block 8; THENCE, in a Northeasterly direction to a point, being the southeast corner of Lot 1, Block 8, out of Tract 50, Harvey Whiting Survey 840; THENCE, in a Northeasterly direction to a point, being the Northeast corner of Lot 1, Block 8, out of Tract 50, Harvey Whiting Survey 840; THENCE, at right angles in a Westerly direction, a distance of 380' to a point in the South right -of -way line of Spur 330; THENCE, in a Southerly direction 150' West of and parallel to the West right - of -way line of Garth Road, to a point, being the northwest corner of Lot 2, Block 9, Morrell Park Subdivision; THENCE, in a Southerly direction to a point, being the Southwest corner of Lot 2, Block 27, Morrell Park Subdivision; THENCE, in a Southerly direction to a point in the South right -of -way line of Park Street, 200' West of the West right -of -way line of Garth Road; THENCE, in a Southerly direction, 200 feet from and parallel to the curva- ture of the West right -of -way line of Garth Road to a point 200 feet North- east of the Northeast right -of -way line of Decker Drive; THENCE, in a Northwest direction parallel to, and at all points a distance of 200 feet from, the Northeast right -of -way line of Decker Drive to a point of intersection with the East bank of Goose Creek Stream; THENCE, in a Southwesterly direction along the East bank of Goose Creek Stream a distance of 500 feet to a point; THENCE, in a Southeasterly direction, 200 feet from, and parallel to, the Southwest right -of -way line of Decker Drive to a point of intersection with a line which is located 100 feet South of, and parallel to, the South right - of -way line of West Sterling Street; THENCE, in an Easterly direction along the line which is located 100 feet South of, and parallel to, the South right -of -way line of West Sterling Street to a point which is 150 feet perpendicularly from the Southwest right -of -way line of Decker Drive; THENCE, in a Southeasterly direction parallel with Decker Drive and at all points 150 feet West of the Westerly right -of -way line thereof, to the point of intersection with the North right -of -way line of West Texas Avenue extension; THENCE, in a generally Southwesterly direction parallel with the North right -of -way line of Market Street, and at all points 150 feet North of the said right -of -way line to a point on the East property line of Block 15, Airhart Addition; THENCE, in a Southwesterly direction a distance of approximately 150 feet to a point, being the Southeast corner of Lot 6, Block 15, Airhart Addition; THENCE, in a Southeasterly direction to a point, being the intersection of the North right -of -way of West Main Street, and the South right -of -way of Market Street; -4- THENCE, in a Southeasterly direction along the North right -of -way line of West Main Street to a point, said point being the Southwest corner of Tract 53 -B, William Scott Survey, A -66, and said point further being the POINT OF BEGINNING. (B) BEGINNING at the northeast corner of Lot 3, Block 16 of the Thomas Wright Addition, said beginning point being on the South line of East James Street; THENCE, in a northerly direction 150' east of and parallel to the east right -of -way line of North Main Street, to a point in the south right - of -way line of Bob Smith Road; THENCE, in a northeasterly direction to a point in the north right -of -way of Bob Smith Road, same being 190' east of the east right -of -way of North Main Street; THENCE, in a northerly direction to the south right -of -way line of Baker Road; THENCE, in a westerly direction along the south right -of -way line of Baker Road, a distance of 470' for corner; THENCE, in a southerly direction 200' west of and parallel to the west right -of -way line of North Main Street, to a point, being the northeast corner of Lot 15, Block 11, Woodlawn Subdivision; THENCE, in a southerly direction along the east line of Block 11, to a point being the southeast corner of Lot 1, Block 11 Woodlawn Subdivision; THENCE, in a westerly direction along the north right -of -way line of Forrest Avenue, to a point, being the southwest corner of Lot 1, Block 11, Woodlawn Subdivision; THENCE, in a southerly direction to a point, being the northwest corner of Lot 9, Block 7, Leavins Subdivision; THENCE, in a southerly direction to a point, being the southwest corner of Block 31, Martin Subdivision; THENCE, west to a point being the southeast corner of Lot 1, Block 11, Martin Subdivision; THENCE, south a distance of 50' to a point, being the northeast corner of Lot 8, Block 7, Martin Subdivision, this point being the north line of the #1 Fire Zone; THENCE, in an easterly direction along the south line of East James Street to the POINT OF BEGINNING. (C) BEGINNING at a point on the West right -of -way line of North First Street, said point being located North 100 feet from the North right -of -way line of East Texas Avenue; THENCE, in an Easterly direction along a line which is located 100 feet North of, and parallel to, the North right -of -way line of East Texas Avenue to the Northeast corner of Lot 1, Block 2, Danubina Court Addition; THENCE, in a Northeasterly direction along the North line of Lots 2 and 3 of Block 2, Danubina Court Addition, to the Northwest corner of Lot 4, Brock 2 of said Addition; -5- THENCE, in an Easterly direction along the North line of Lot 4, Block 2 of said Addition to a point which is 100 feet West of the West right -of- way line of State Highway 146; THENCE, in a Northerly direction along a line which is 100 feet from, and parallel to, the West right -of -way line of State Highway 146 to a point on the South right -of -way line of Bob Smith Road; THENCE, in an Easterly direction along the South right -of -way line of Bob Smith Road to a point of intersection with West right -of -way line of State Highway 146; THENCE, Southeasterly with a line that is perpendicular to the center line of State Highway 146 to a point that is 100 feet Southeasterly of the East right -of -way line of State Highway 146; THENCE, Southerly along a line which is 100 feet from, and parallel to, the East right -of -way line of State Highway 146 to a point of intersection with the North line of Block 8, Danubina Court Addition, Section 2; THENCE, in an Easterly direction 209.5 feet to a point for corner; THENCE, in a Southerly direction to a point 200 feet South of the South right -of -way line of East Texas Avenue, said point also being 308.59 feet from the East right -of -way line of State Highway 146; THENCE, in a Westerly direction along a line 200 feet South of, and parallel to, the South right -of --way line of East Texas Avenue to a point 100 feet from the East right -of -way line of State Highway 146; THENCE, in a Southerly direction along a line which is 100 feet East of, and parallel to, the East right -of -way line of State Highway 146 to a point on the North line of the Ashbel Smith Land Company 1.423 acre tract of land; THENCE, in a Westerly direction, crossing State Highway 146, to a point on the South line of the Benny Gray Addition, said point being 100 feet West of the West right -of -way line of State Highway 146; THENCE, in a Northerly direction, 100 feet from, and parallel to, the West right -of -way line of State Highway 146 to a point on the North line of East Pearce Street; THENCE, in a westerly direction to a point of intersection with the East line of South Eighth Street; THENCE, in a Northerly direction to a point which is 100 feet South of the South right -of -way line of East Texas Avenue; THENCE, in a Westerly direction along a line which is 100 feet South of and parallel to, the South right -of -way line of East Texas Avenue to a point on the West right -of -way line of South First Street; THENCE, in a Northerly direction along the West right -of -way line of South First Street, crossing East Texas Avenue, and continuing along the West right -of -way line of North First Street to the POINT OF BEGINNING. M Section 3: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
