Ordinance No. 1,350ORDINANCE NO. 1350 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF BAYTOWN, TEXAS; AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: On the 8th day of February, 1973, at 7:00 o'clock p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, the City Council will hold a public hearing giving all interested parties the right to appear and be heard on the proposed annexation by the City of Baytown, Texas, of the following described property, to -wit: BEGINNING at a point on the existing City of Baytown City Limit line, said point being on a line which is an Eastward projection of the North right -of -way line of Baker Road at a distance of two hundred (200') feet East of the East right -of -way line of North Main Street; THENCE, in a Westerly direction along the North right -of -way line of Baker Road a distance of twelve hundred twenty -three (1,223') feet to a point; said point being the Southwest corner of Sunrise Court Sub- division and the Southeast corner of the Goose Creek Independent School District property; THENCE, North 0 degrees 27 minutes East a distance of eight hundred ninety - three and twenty -three hundredths (893.23') feet to a point; THENCE, North 89 degrees 50 minutes East a distance of nine hundred sixty - two (962.0') feet to a point on the Westerly right -of -way line of North Main Street; THENCE, along said Westerly right -of -way line of North Main Street North 0 degrees 28 minutes East a distance of sixty (60') feet to a point; THENCE, South 89 degrees 50 minutes West a distance of nine hundred forty - nine and ninety hundreths (949.90') feet to a point; THENCE, North 0 degrees 04 minutes East a distance of eight hundred ninety - six and sixty hundredths (896.60') feet to a point; THENCE, South 89 degrees 50 minutes West a distance of four hundred ninety (490.0') feet to a point; THENCE, North 0 degrees 04 minutes East a distance of nine hundred and forty hundredths (900.40') feet to a point on the South right -of -way line of the Cedar Bayou - Lynchburg Road; THENCE, South 88 degrees 24 minutes West along said South right -of -way line of the Cedar Bayou - Lynchburg Road a distance of approximately eight hundred eighty (880') feet to a point of intersection with the center line of a Harris County Flood Control District drainage easement, said drainage easement being an extension of the East Fork of Goose Creek; THENCE, in a Northerly direction along the center line of the Harris County Flood Control District easement a distance of approximately two thousand four hundred fifteen (2,415') feet to a point of inter- section with the South right -of -way line of South Road in the East End Addition, Ed T. Schaffer Survey, Abstract No. 1224; THENCE, in an Easterly direction along the South right -of -way line of South Road a distance of approximately one thousand four hundred thirty - two (1,432') feet to a point on the East line of the Ed. T. Schaffer Survey, Abstract No. 1224; and continuing along an extension of the South right -of -way line of South Road across the H. E. Gillette Survey, Abstract No. 297, to a point on the West right -of -way line of North Main Street; THENCE, South along the West right -of -way line of North Main Street to a point approximately two hundred (200') feet North of the North right -of -way line of Lynchburg -Cedar Bayou Road as it extends Westward from North Main Street, said point being in line with the extension across North Main Street of the North right -of -way line of Cedar Bayou - Lynchburg Road; THENCE, Easterly with the extension of the North right -of -way line of Cedar Bayou- Lynchburg Road across North Main Street and continuing along the North right -of -way line of Cedar Bayou - Lynchburg Road a distance of approximately four hundred ten (410') feet to a point, said point being in line with the East property line of the Jack Sawberger one acre tract in the J. W. Singleton Survey, Abstract No. 709; THENCE, Southward, crossing Cedar Bayou - Lynchburg Road, and continuing Southward along the East line of the Jack Sawberger one acre tract and the extension of this line a distance of approximately one thousand six hundred ninety (1,690') feet to a point, said point being at the inter- section of the East property line of the S. L. Goodman 3.63 acre tract and the North property line of the M. E. Goodman five acre tract; THENCE, Eastward along the North property line of the M. E. Goodman five acre tract a distance of approximately seven hundred sixteen (716') feet to a point, said point being the Northeast corner of the said M. E. Goodman five acre tract; THENCE, Southward along the East property line of the M. E. Goodman five acre tract and the Southward extension of this line a distance of approximately one thousand one hundred thirty -four (1,134') feet to a point, said point being the Southeast corner of a 2.19 acre tract, Rayborn C. Johnson, Trustee; THENCE, Westward along the South property line of the 2.19 acre tract, Rayborn C. Johnson, Trustee, and an extension of this line a distance of approximately eight hundred seventy (870') feet to a point, said point being two hundred (200') feet from the East right -of -way line of North Main Street; THENCE, Southward, two hundred (200') from and parallel to the East right -of -way line of North Main Street to the POINT OF BEGINNING. -2- SAVE AND EXCEPT that property annexed by Ordinance No. 1194 on final reading by the City Council on April 18, 1972, said property being described as follows, to -wit: BEGINNING at a point on the existing city limit line of the City of Baytown, said point being located on the South right -of -way line of the Cedar Bayou - Lynchburg Road where a Southerly projection of the East right -of-way line of East Road intersects; THENCE, North 9 °52' West along the projection of the East right -of -way line of East Road to a point on the North right -of -way line of the Cedar Bayou- Lynchburg Road; THENCE, continuing North 9 °52' West a distance of 575.5 feet along the East right -of -way line of East Road to a point for corner; THENCE, North 80 °08' East a distance of 973.5 feet to a point for corner, said point being on the East line of Lot 7, Block 21, HIGHLAND FARMS SUBDIVISION; THENCE, North 10 °00' West a distance of 1,359.5 feet to a point for corner, said point being on the North line of a 45 feet wide Harris County drainage easement; THENCE, South 77 °59' West a distance of 560.4 feet to a point; THENCE, South 80 008' West a distance of 410.5 feet to a point for corner, said point being on the East right -of -way line of East Road; THENCE, South 9 °52' East a distance of 1,328.5 feet along the East right -of -way line of East Road to a point for corner, said point being 10 feet from the Southwest corner of the thirty (30) Acre tract pur- chased by the City of Baytown for park purposes; THENCE, South 80 °08' West a distance of 10 feet to a point for corner, said point being 10 feet West of the East right -of -way line of East Road; THENCE, South 9 052' East parallel to the East right -of -way line of East Road approximately 645.5 feet to a point on the South right -of -way line of the Cedar Bayou - Lynchburg Road; THENCE, Eastward along the South right -of -way line of Cedar Bayou- Lynchburg Road approximately 10 feet to the POINT OF BEGINNING. Section 2: The City Clerk of the City of Baytown is hereby authorized and directed to cause notice of such public hearing to be published once in a news- paper having general circulation in the city and in the above described territory not more than twenty (20) days nor less than ten (10) days prior to the date of such public hearing, all in accordance with the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session, 1963; compiled as 970x, Vernon's Texas Civil Statutes, as amended). -3- Section 3: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown. The City Council of the City of Baytown, Texas, convened in Regular Meeting on the 25th day of January, 1973, in the City Hall, within sai Cd ity, and the roll was called of the duly constituted officers and members of said City Council, to -wit: Glen Walker Mayor Charles Pool Councilman Charley 0. Whereupon, among other business, the following was transacted at said meeting: a written ORDINANCE APPROVING CLAIM AND AUTHORIZING DELIVERY OF CERTIFICATES OF OBLIGATION was duly introduced for the consideration of said City Council and read in full. After due discussion, it was then duly moved and seconded that said ordinance be adopted; and said motion carried by the following vote: AYES: All members of said City Council shown present above voted "Aye." NOES: None. 2. That a true, full, and correct copy of the aforesaid ordinance adopted at the meeting described in the above and foregoing paragraph is attached to and follows this certificate; that said ordinance has been duly recorded in said City Council's minutes of said meeting; that the persons named in the above and fore- going paragraph are the duly chosen, qualified, and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sufficiently notified officially and personally in advance, of the time, place, and purpose of the aforesaid meeting, and that said ordinance would be introduced and considered for adoption at said meeting; that said meeting was open to the public as required by law; and that public notice of the time, place, and subject of said meeting was given as required by Article 6252 -17, Vernon's Texas Civil Statutes, as amended. 3. The Mayor of said City has approved, and hereby approves, the aforesaid ordinance: the Mayor and the City Clerk of said City have duly signed said or- dinance; and the Mayor and City Clerk of said City hereby declare that their signing of this certificate shall also constitute the signing of the attached and following copy of said ordinance for all purposes.
