AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN,
TEXAS, BY THE AMENDMENT OF CHAPTER 27, "SUBDIVISIONS ", BY AMENDING
ARTICLE II, PROCEDURE, BY THE ADDITION OF A NEW SECTION 27 -22, THEREOF,
REPEALING ORDINANCES INCONSISTENT HEREWITH, CONTAINING A SAVINGS CLAUSE;
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of Baytown, Texas, is
hereby amended by amending Chapter 27, "Subdivisions ", by amending Article II,
Procedure, by the addition of a new Section 27 -22 which shall read as follows,
to -wi t:
Section 27 -22. Filing fee for plats.
(a) All applications to the City Planning Commission for the approval
of any proposed plat required to be submitted to the commission, shall be
submitted to the City Planning Department and shall be accompanied by a
filing fee of Fifty and No /100 Dollars ($50.00) applicable to the final
fee. Applicants shall also furnish to the City Planning Department ad-
ditional fees as determined by said department in conformance with the
following schedule and the City Planning Commission shall not act upon
any plat submitted to it unless all fees as provided herein have been
received.
(1) Final plat.
(i) One and No /100 Dollar ($1.00) per dwelling unit, plus Five
and No /100 Dollars ($5.00) per acre for other uses, but not
less than Fifty and No /100 Dollars ($50.00).
(2) Vacation of subdivisions.
(i) Twenty -five and No /100 Dollars ($25.00) filing fee, plus
(ii) Fifteen and No /100 Dollars ($15.00) per acre (gross area of
whole tract).
(b) Filing fees for plats submitted prior to the passage of this
section [December 7, 1971] may be paid under the previous fee schedule
providing such payment is made within ten (10) days of the passage of
this section [December 7, 1971].
Section 2: Repealing Clause: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.

Section 3: Savings Clause: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this ordinance or the
application of same to any person or set of circumstances, shall for any reason
be held unconstitutional, void or invalid, such invalidity shall not affect
the validity of the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all provisions of
this ordinance are declared to be severable.
Section 4: Effective Date: This ordinance shall take effect from
and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council
