Ordinance No. 1,326ORDINANCE NO. 1326 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PURCHASE OF TWO PARCELS OF LAND OUT OF THE 12.53 ACRE TRACT OF LAND LOCATED IN THE HARVEY WHITING SURVEY, A -840 IN THE CITY OF BAYTOWN AS DESCRIBED IN THE DEED RECORDS OF HARRIS COUNTY, TEXAS, UNDER COUNTY CLERK FILE #D565748 FOR EASEMENT PUR- POSES AND AUTHORIZING THE PAYMENT BY THE CITY FOR THE SUM OF TWO THOUSAND EIGHTY -ONE AND 18 /100 ($2,081.18) DOLLARS AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the purchase of two parcels of land for easements purposes being described as follows, to -wit: BEING TWO PARCELS OF LAND OUT OF THE 12.52 ACRE TRACT OF LAND LOCATED IN THE HARVEY WHITING SURVEY, A -840 IN THE CITY OF BAYTOWN, AS DESCRIBED IN A DEED RECORDED IN HARRIS COUNTY DEED RECORDS UNDER COUNTY CLERK FILE #D565748, HARRIS COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS IN EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF. from Johnson- Loggins, Inc. and authorizes the payment by the City of a sum of Two Thousand Eighty -One and 18/100 ($2,081.18) Dollars. Section 2: Effective Date: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. GLEN WALKER, Mayor ., EXHIBIT A EASEMENT I COMMENCING at the Point of intersection of the South right -of -way line of West Texas Avenue with the North right -of -gay line of Market Street; THENCE, with the North right -of -way line of Market Street, along a curve to the right, having a radius of 383.92 feet, a distance of 207.00 feet; THENCE, South 63 degrees, 15 minutes West with the North right -of -way line of Market Street, a distance of 839.61 feet to a ,. -inch steel rod, said steel rod being the Southwest corner of a 0.5165 acre tract of land conveyed to H.D. Becker by R.H. Pruett, et al, as recorded in Volume 6338, Page 377 of the Deed Records of Harris County, Texas; THENCE, North 26 degrees, 45 minutes West a distance of 100.00 feet to a h -inch steel rod for a POINT OF BEGINNING; THENCE, North 26 degrees, 45 minutes West a distance of 50.00 feet to a -inch steel rod for the Northeast corner of the herein described ease- ment, said corner being the Northwest corner of the aforementioned H. D. Becker tract; THENCE, South 63 degrees, 15 minutes West a distance of 10.00 feet to a point for the Northwest corner of the herein described easement; THENCE, South 26 degrees, 45 minutes East a distance of 50.00 feet to a point for the Southwest corner of the herein described easement; THENCE, North 63 degrees, 15 minutes a distance of 10.00 feet to the POINT OF BEGINNING enclosing a tract of land containing 0.0115 acres, more or less. EASEMENT II BEING a permanent easement 20 feet in width and a temporary construction easement 30 feet in width lying parallel to and wholly on the Easterly side of the aforementioned 20 foot wide permanent easement; said ease- ments being out of the 12.53 acre Johnson - Loggins tract located in the Harvey Whiting Survey, A -840 in the City of Baytown, Harris Co=anty, Texas; centerline of said 20 foot wide permanent easement being described as follows: COMMENCING at the Point of Intersection of the South right -of -way line of West Texas Avenue with the North right -of -way line of Market Street; THENCE, with the North right -of -way line of Market Street, along a curve to the right, having a radius of 383.92 feet, a distance of 207 feet; THENCE, South 63 degrees, 15 minutes West with the North right -of -way line of Market Street, a distance of 839.61 feet to a point, said point also being the Southwest corner of a 0.5165 acre tract of land conveyed to H.
