Ordinance No. 1,317ORDINANCE NO. 1317 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 2, "ADMINISTRATION", BY AMENDING ARTICLE V, INSURANCE ADVISORY COMMITTEE, SECTION 2 -106 (A)(2), 2 -106 (B)(3), 2 -106 (D), 2 -108 (b), 2 -108 (c), AND 2 -109 (a) THEREOF, SO AS TO REPEAL THE PROVISIONS OF SUCH SECTIONS AS PRESENTLY CONSTITUTED, AND TO SUBSTITUTE IN THEIR PLACE NEW PROVISIONS, REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by amending Chapter 2, "Administration ", by amending Article V, Insurance Advisory Committee, by repealing Section 2 -106 (A)(2), 2 -106 (B)(3), 2 -106 (D), 2 -108 (b), 2 -108 (c) and 2 -109 (a) thereof, and the same shall cease to have force and effect from and after the effective date of this ordinance. Section 2: That the Code of Ordinances, herein is hereby amended by adding thereto new Sections 2 -106 (A)(2), 2 -106 (B)(3), 2 -106 (D), 2 -108 (b), 2 -108 (c), and 2 -109 (a) in Chapter 2, Article V, which shall read as follows, to -wit: Section 2 -106. Qualifications. (A) (2) As used herein the term "agent" shall mean a natural person or persons. The benefits hereunder shall accrue on an agency basis, and an agent shall be eligible to benefits under one agency only. No more than one person employed directly or indirectly in an agency shall parti- cipate in the operation of the ADVISORY COMMITTEE or receive benefits thereunder, provided that an agent may designate a licensed partner, a regularly employed solicitor or employee who is experienced in insurance as his representative. (B) (3) Members of the Advisory Committee shall not engage in full - time employment in any occupation outside the insurance in- dustry, except combined real estate business. (D) Own a fee interest in real property within the corporate limits of the City of Baytown. Section 2 -108. Management and procedure. (b) The City Manager shall review all applications for membership and approve all applications found to be in compliance with the terms of this or- dinance, and shall furnish the chairman of the advisory committee a copy of the approved list on or before the meeting scheduled in Section 4 (A) each year. (c) The executive committe consisting of three (3) members shall be elected from among the membership approved for the year ensuing. Each member present shall be entitled to one vote and an affirmative majority of those present and voting shall constitute the election of the executive committee. The chairman of the executive committee and a vice - chairman of the executive committee, who shall preside at advisory committee meetings in the absence of the chairman, shall be elected by the advisory committee as a whole and in the same manner. Section 2 -109. Attendance. (a) All members or designated representative will be required to attend the initial meeting each year as well as all other meetings called by the EXECUTIVE COMMITTEE CHAIRMAN, except as provided in Section 2 -109 (b). Notice of meetings called by the EXECUTIVE COM- MITTEE CHAIRMAN shall be given to all members by such means and at such times as the ADVISORY COMMITTEE may prescribe. Section 3: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
