Ordinance No. 1,316ORDINANCE NO. 1316 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 17 1/2, "MOBILE HOME PARKS ", BY ADDING SECTION 17 1/2 -18.1, PERMANENT PLACEMENT OF MOBILE HOME, REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the Code of Ordinances of the City of Baytown provides rules and regulations pertaining to mobile homes and mobile home parks; and WHEREAS, such Code of Ordinances does not provide for the permanent placing of mobile homes in licensed mobile home parks or in permissible areas outside a mobile home park; and WHEREAS, in order to eliminate the requirement of the mobile home owner and the mobile home park owner from securing a parking permit for the mobile home that is permanently placed; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by adding to Chapter 17 112, "Mobile Home Parks ", a new section 17 1/2 -18.1, Permanent Placement of Mobile Home, which shall read as follows, to-wi t: Section 17 1/2 -18.1. Permanent Placement of Mobile Home. That the �arking permit requirement found in Section 17 1/2 -4(1) and 17 1/2 -19(7 shall not apply to a mobile home permanently located on real property where said mobile home is attached and affixed in the manner prescribed as follows: (a) Tire and wheels, suspension components comprised of axles, shackles, springs, and other protrusions beneath the frame, shall also be removed if necessary, so as to permit the level placement of the mobile home at a height above the surrounding frame no greater than 24" and no less than 12 ". The soil beneath the trailer shall be slopped or graded, so as to prevent water from eroding or standing. (b) A reinforced concrete support shall be located at each corner and mid -way on either side of the mobile home, and shall not be less than 8" square or 6" in diameter and placed on a 4" thick reinforced concrete pad containing at least 4 square feet in surface area. (c) Opaque or solid skirting and screening or skirting and screening with openings of a width no greater than one -half (1/2 ") inch, shall be attached to the home with galvanized screws or bolts. (d) The mobile home shall be connected to and provided with water- lines and sanitary sewer connections. (e) The lot or tract of land upon which a mobile home is situated shall be large enough to accommodate a parking stall thereon for the off - street parking of automobiles. (f) There shall be a driveway constructed upon such lot or tract of land leading from the public street to the mobile home or adjacent to the mobile. (g) The area of the mobile home stand shall be improved to provide adequate support for the placement and tie -down of the mobile home, thereby securing the superstructure against uplift, sliding, rotation and overturning. (1) The mobile home stand shall not heave, shift or settle un- evenly under the weight of the mobile home due to frost action, inadequate drainage, vibration or other forces acting on the structure. (2) The mobile home stand shall be provided with anchors and tie -downs such as cast -in -place concrete "dead men ", eyelets imbedded in concrete foundations or runways, screw augers, arrowhead anchors, or other devices securing the stability of the mobile home. (3) Anchors and tie -dows shall be placed at least at each corner of the home stand, and no more than 20' apart, and each shall be able to sustain a minimum tensile strength of 2,800 pounds. (h) All applicable requirements of the Building Code of the City of Baytown, applicable to the installation of plumbing, electricity, water and gas must be complied with and the necessary permits acquired prior to the mobile home being placed on the private lot. The Building In- spector of the City of Baytown shall supervise and inspect the permanent placement of a mobile home in compliance with this ordinance. (i) No enclosure may be built to this permanently placed mobile home containing any material which is not of a non - combustible nature. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordi- nances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. -2- Section 4: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
