AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE
PURCHASE OF THIRTY -SEVEN (37) ACRES MORE OR LESS SITUATED IN
THE BROWNWOOD SUBDIVISION TO SECURE FILL DIRT FOR PERIMETER
ROADS FROM THE BROWN ESTATE; AUTHORIZING THE PAYMENT BY THE
CITY OF A SUM OF FIVE HUNDRED AND NO /00 ($500.00) DOLLARS PER
ACRE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
WHEREAS, the City Council of the City of Baytown, Texas, did authorize
A. J. Busch, Consulting Engineer for the City of Baytown, to advertise for bids
for the construction of a levee road around the perimeter of the Brownwood Sub-
division including all required fill and excavation work, road sub -base preparation
and surfacing, construction of drainage structures, vertical adjustment of sanitary
sewer manholes, and installation of an arterial water main to be received July 5,
1972; and
WHEREAS, notice to bidders as to the time and place, when and where the
contract for said construction would be let was published pursuant to provisions
of Vernon's Civil Statutes, Article 2368a; and
WHEREAS, all bids were opened and publicly read at City Hall at 10:00
o'clock a.m., Wednesday, July 5, 1972, as per the published notice to bidders;
and
WHEREAS, the City Council of the City of Baytown accepted the bid of
Skrla, Inc. for the construction of said levee road around the perimeter of
Brownwood Subdivision; and
WHEREAS, it is necessary to acquire land in order to secure fill dirt
for said project; and
WHEREAS, the fact that the streets and portions thereof to be improved
as heretofore and hereinabove provided for are in bad and dangerous condition
and should be improved without delay creates an emergency and imperative public
necessity for the immediate preservation of the public peace, health, safety,
and welfare; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That the City Council of the City of Baytown, Texas, hereby
declares that an emergency situation exists.
Section 2: That the City Council of the City of Baytown hereby authorizes
the purchase of a certain tract of land containing thirty -seven (37) acres more
or less in order to secure fill dirt for perimeter roads from the Brown Estate
for the sum of Five Hundred and No /100 ($500.00) Dollars per acre less an amount
equal to the taxes due and owing on said property for the year 1972, said property
being described as follows, to -wit:
BEING a parcel of land out of the Nathaniel Lynch Survey, A -44, and being
a part of Lots 12, 13 and 14 of the Wooster Subdivision, recorded by plat
in Volume 65, at Page 274 and 275 of the Harris County Deed Records, Harris
County, Texas, and being more particularly described by metes and bounds,
as follows:
BEGINNING at the Point of Intersection of the West right -of -way line
of Steinman Avenue with the North right -of -way line of Shreck Avenue;
THENCE, Southwesterly with the North right -of -way line of Shreck Avenue
to the Point of Intersection of said right -of -way line with the Northeast
right -of -way line of Brownwood Drive;
THENCE, Northwesterly with the Northeast right -of -way line of Brownwood
Drive to the Point of Intersection with the Northeast lot line of Lot 18,
Block BB, Brownwood Subdivision;
THENCE, North 30 036' West, with the Northeast lot line of said Lot 18, a
distance of 482.5 feet, to the intersection of said lot line with the
Burnett Bay shoreline;
THENCE, Northeasterly with the meanders of Burnett Bay shoreline to the
confluence of the centerline of Fresh Water Bayou;
THENCE, Northeasterly with the meanders of centerline of said Fresh Water
Bayou to its Point of Intersection with the Southerly property line of a
tract of land conveyed to Gene B. Hazelwood by deed recorded in Volume
5152 at Page 130 in Harris County Deed Records;
THENCE, South 60 °30' East with said Southerly property line a distance
of 219.65 feet to the Point of Intersection with the West right -of -way
l ne of Steinman Avenue;
THENCE, Southerly with the West right -of -way line of Steinman Avenue to
the POINT OF BEGINNING, enclosing a tract of land containing 37 acres
more or less.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council
of the City of Baytown on this 14th day of September, 1972.
