Ordinance No. 1,274ORDINANCE NO. 1274 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A CONTRACT WITH SKRLA, INC. FOR THE CONSTRUCTION OF A LEVEE ROAD AROUND THE PERIMETER OF THE BROWNWOOD SUBDIVISION INCLUDING ALL REQUIRED FILL AND EXCAVATION WORK, ROAD SUB -BASE PREPARATION AND SURFACING, CONSTRUCTION OF DRAINAGE STRUCTURES, VERTICAL ADJUSTMENT OF SANITARY SEWER MAN- HOLES, AND INSTALLATION OF AN ARTERIAL WATER MAIN, JOB NO. 70 -506, AS PART OF THE CAPITAL IMPROVEMENTS PROGRAM, AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF FOUR HUNDRED SIXTY -TWO THOUSAND FOUR HUNDRED SEVENTY -SEVEN AND NO /100 ($462,477) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown, Texas, did authorize A. J. Busch, Consulting Engineer for the City of Baytown, to advertise for bids for the construction of a levee road around the perimeter of the Brownwood Sub- division including all required fill and excavation work, road sub -base preparation and surfacing, construction of drainage structures, vertical adjustment of sanitary sewer manholes, and installation of an arterial water main to be received July 5, 1972; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes, Article 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 o'clock a.m., Wednesday, July 5, 1972, as per the published notice to bidders; and WHEREAS, the fact that the streets and portions thereof to be improved as heretofore and hereinabove provided for are in bad and dangerous condition and should be improved without delay creates an emergency and imperative public necessity for the immediate preservation of the public peace, health, safety and general welfare; N014 THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That, the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That the City Council of the City of Baytown, Texas, hereby accepts the bid of Skrla, Inc. for the construction of a levee road around the perimeter of the Brownwood Subdivision including all required fill and excavation work, road sub -base preparation and surfacing, construction of drainage structures, vertical adjustment of sanitary sewer manholes, and installation of an arterial water main according to the plans and specifications set forth by the Consulting Engineer on a construction timetable at 180 days for the sum of Four Hundred Sixty -Two Thousand Four Hundred Seventy- -Seven and No /100 ($462,477) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to ex- ecute and attest to a contract with Skrla, Inc. for said construction of a levee road around the perimeter of the Brownwood Subdivision including all required fill and excavation work, road sub -base preparation and surfacing, construction of drainage structures, vertical adjustment of sanitary sewer manholes, and in- stallation of an arterial water main containing the plans, specification and requirements of the Consulting Engineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown this 14th day of September , 1972.
