Ordinance No. 1,273ORDINANCE NO. 1273 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CLOSING THE HEARING GIVEN TO THE REAL AND TRUE OWNERS OF THE PROPERTY ABUTTING UPON CROW ROAD, MAPLETON AVENUE, SOUTH BAYSHORE DRIVE, EAST BAYSHORE DRIVE, BROWNWOOD DRIVE, AND WEST BAYSHORE DRIVE, WITHIN THE LIMITS HEREINBELOW DEFINED, IN THE CITY OF BAYTOWN, TEXAS, AS TO SPECIAL BENEFITS TO ACCRUE BY VIRTUE OF THE IMPROVEMENT THEREOF, AND AS TO THE ACCURACY, SUFFICIENCY, REGULARITY AND VALIDITY OF THE PROCEEDINGS IN CONNECTION WITH SAID IMPROVEMENTS, AND THE ASSESSMENTS TO BE LEVIED COVERING THE COST THEREOF; OVERRULING AND DENYING ALL PROTESTS AND OBJECTIONS OFFERED EXCEPT AS TO THE ADJUSTMENTS HEREINBELOW MADE; FINDING AND DETERMING SPECIAL BENEFITS TO EACH PARCEL OF PROPERTY AND THE OWNERS THEREOF EQUAL TO OR IN EXCESS OF THE AMOUNT OF THE SPECIAL ASSESSMENTS AS HEREIN ADJUSTED AND ASSESSED AGAINST SAME; FINDING THE REGULARITY OF ALL PROCEEDINGS AND THE PERFORMANCE OF ALL PREREQUISITES TO FIXING THE ASSESSMENT LIENS AND THE PERSONAL LIABILITY OF THE PROPERTY OWNERS; LEVYING ASSESSMENTS, FIXING CHARGES AND LIENS AGAINST SAID PROPERTY ABUTTING SAID STREET AND THE TRUE OWNERS THEREOF FOR PAYMENT OF PART OF THE COSTS OF THE IMPROVEMENTS; PROVIDING FOR THE ISSUANCE OF ASSIGNABLE ASSESSMENT CERTIFICATES AND THE MANNER OF THEIR COLLECTION; PROVIDING FOR OTHER MATTERS RELATING TO THE FOREGOING; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: SECTION 1: The City Council of the City of Baytown, Texas, hereby finds and determines: (a) That by Ordinance No. 1256, duly enacted on the 18th day of July, 1972, said City Council did determine the necessity for and ordered the permanent improvements of the following named streets in the City of Baytown within the following limits, to --wit: Crow Road from a point five (5) east of the property line of Lot 12, Block 2 of Brownwood Subdivision to the west line of the intersection of Crow Road and Mapleton Avenue, Mapleton Avenue from the south line of the intersection of Mapleton Avenue and Crow Road to the southwest line of the intersection of Mapleton Avenue and South Bayshore Drive, South Bayshore Drive from the northwest line of the intersection of South Bayshore Drive and Mapleton Avenue to its intersections with east Bayshore Drive and West Bayshore Drive, East Bayshore Drive from its intersection with West Bayshore Drive to its intersection with Brownwood Drive, it being also the northwest right -of -way line of Shreck Avenue, Brownwood Drive from its intersection with East Bayshore Drive as defined above, to the east right -of -way line of Latham Street, West Bayshore Drive from its intersection with East Bayshore Drive to a point 15 feet west of the west property line of Lot one (1), Block "B" of Brownwood Subdivision. (b) That said City Council, after having duly advertised for bids in the manner and for the time as required by law and the Charter of said City did determine that the bid of Skrla Inc. was the lowest and best bid for the construction of said improvements. (c) That pursuant to the finding and determination by City Council, that apportioning the assessed portion of the cost of the project on a front foot plan or rule would result in injustices and inequities, the City's Engineer, thereafter as instructed. by the City Council, prepared and filed with the City Council a proper statement of the estimates of the costs of the improvements of said streets and of the estimates of the amounts proposed to be assessed against the property abutting hereupon and the owners thereof and of other costs and matters relating thereto, all as required by law, which statement of estimates was received, examined and approved by the City Council by Ordinance No. 1266 enacted on August 7, 1972, and further said City Council did by said Ordinance No. 1266 order and set a hearing to be held at 6:30 o'clock p.m. on the 14th day of September, 1972, in its Council Chambers at the City Hall of and in the City of Baytown, Texas, for the real and true owners of the properties abutting upon said street, within said limits defined and for all others owning or claiming any interest in, or otherwise interested in said properties or any of said matters as to the assessments and amounts proposed to be assessed against each parcel of said abutting property and the owners thereof and as to the special benefits to accrue to said abutting properties and the owners thereof by virtue of said improvements, if any, or concerning any error in validity, irregularity or deficiency in all proceeding or contract concerning same, at which time all persons, firms, corporations, estates, owning or claiming any such abutting property, their agents or attorneys, or any persons interested in said proceedings, might appear in person or by counsel and offer evidence. (d) That said City Council did further by said Ordinance No. 1266 order and direct the City Clerk of said City to give notice of said hearing in the manner and for the time as required by the law and the Charter of said City; and said notice, as so ordered and directed and as required by law governing these proceedings, has been properly and duly given, in the form and for the time as required by said law, by the publication thereof at least three (3) times before the date of said hearing in the Baytown Sun, a newspaper published in the City of Baytown, Texas, the first publication being made at least twenty -one (21) days before the date of said hearing, the dates of such publications being August 20, 1972, August 21, 1972, and August 22, 1972, and further by the City Clerk giving additional written notice of said hearing by depositing in the United States mail, at least fourteen (14) days before the date of said hearing, written notice of such hearing, postage prepaid, in an envelope addressed to the owners of the respective properties abutting upon said street, within the limits above defined, as the names of such owners are shown on the then current rendered tax rolls of the City of Baytown, Texas, and at the addresses so shown thereon, or if the names of such respective owners did not appear on such rendered tax rolls, then addressed to such owners as -2- their names are shown on the then current unrendered tax rolls of said City at their addresses shown thereon, which additional written notices by mailing were deposited in the United States mail by the City Clerk on August 30, 1972, as evidenced by the sworn affidavit of said City Clerk filed with the City Council and which sworn affidavit together with its attached list of the names and addressed of said owners are here ordered and provided to be filed and recorded among said City's official records and that same shall hereafter constitute a part of said City's official records. (e) That after due, regular and proper notice thereof, all as provided by, and in accordance with, said law and the Charter of said City, said hearing which notice was so given was opened and held at 6:30 o'clock p.m. on the 14th day of September, 1972, in the Council Chambers at the City Hall of and in the City of Baytown, Texas, pursuant to said Ordinance calling same and the notice thereof, at which time an opportunity was given to all of said property owners and other interested parties, their agents and attorneys, to be heard and to offer evidence as to all matters mentioned or referred to, and in accordance with said Ordinances, notices and the law under which these proceedings are being had, at which time the following appeared and testified substantially as follows, to -wit: A. J. BUSCH, of Busch Hutchison & Associates, the City's Engineer, explained the general type, nature and extent of the improvement proposed to be constructed under this project, same being the raising of the elevation of streets named herein to a level of 7 feet above mean sea level and the construction thereupon of a flexible base of compacted limestone with a bituminous surface and other appurtenances and incidentals to such improvements. OTIS GRAHAM, 1901 Mockingbird, Baytown, Texas, a Realtor, in response to questions from the City Attorney, testified that he was a resident of Baytown engaged in the real estate business since 1947 in said City. He further testified that he was familiar and acquainted with real estate values generally in the City of Baytown and particularly with the various properties abutting upon the portion to be improved under this project; that he is familiar with the general nature and type of the improvements to be constructed by the City and with the proposed rates of assessment to be charged against said abutting properties as set out in the published notice of this hearing; that, in his opinion, if said improvements are constructed as proposed by the City, all of the properties having residences thereupon and abutting upon a portion of street to be so improved will be specially benefited in enhancement in value as a result of the construction of such improvement in that ingress and egress to said property will be afforded, and that in the case of abutting property having a residence situated thereupon which property is situated on the inland side of the street (interior property), the amount of such enhancement in value will be $500.00, and in the case of the property having a residence situated thereupon which property is situated between the road and the bay, the amount of such enhancement in value will be $250.00. ALBERT "EUGENE" BURCH, 136 Bayshore, Baytown, Texas, came forward to testify that according to Mr. Graham, property would be enhanced in value due to ingress and egress in high water. However, in his case his property is of no value due to the fact it is uninhabitable a large part of the year and he has been unable to rent it since December, 1971. -3- MRS. E. J. FISHER, 152 Mapleton, Baytown, Texas, stated that the im- provement would not necessarily be of benefit to her, in that she presently has ingress and egress to her property. In fact, she stated that she has resided at 152 Mapleton since 1962 and has never been forced out because of high water. MR. W. TRAVIS PORTER, 186 Bayshore Drive, Baytown, Texas, had no ob- jections to voice. In fact, he, as well as the Brownwood Civic Association went on record as being completely in favor of this improvement and assessment, the assessment being both reasonable and fair. MRS. R. C. ANDERSON, 132 West Bayshore, Baytown, Texas, inquired as to whether or not provision had been made to raise driveways to correspond with the elevated road. A. J. Busch in response to the previous question stated that Council had given authorization to modify driveways at a slope to intersect with the road and cover driveways with oyster shell. MR. JEFF BROWN, 102 West Bayshore Drive, Baytown, Texas, had questions concerning the assessment against the following property: West Bayshore Drive South Side Lot 29 & 28, Brownwood of Wooster Published Assessment $500.00 Lot 2, Block B. Brownwood Subdivision of Wooster Published Assessment $250.00 Mapleton -South Side West 66.06' of 7, Block K, Wooster Published Assessment $250.00 Mr. Neel Ric Mr. Neel Richardson, City Attorney, in response to the foregoing questions explained that these were errors in the assessment roll as published and that correction had been made to indicate assessments of $250.00, 0 and 0 respectively. MR. CLYDE H. TACKER of 106 Tuscany, Sugarland, Texas, the owner of property at 132 and 134 Bayshore Drive, Baytown, Texas, testified that both of the aforementioned parcels were under water, therefore ingress and egress would be of no assistance to him. He concluded that since these residences are uninhabitable, the property should not be assessed. MR. GLEN STANKIS of 717 Grantham Road, Baytown, Texas, owner of property on Mapleton South Side asked if driveways to vacant lots would be improved. A. J. Busch in response to the previous question explained that the plans and specifications approved by Council made no provision for improvement of driveways on vacant property. -4- (f) That said City Council has heard evidence as to the special benefits in enhanced value to accrue to said abutting properties, and the real and true owners thereof; as compared with the portion of the cost of con- structing said improvements proposed to be assessed against said properties and has heard all parties appearing and offering testimony, together with all protests and objections relative to such matters and as to any errors, invalidities or irregularities in any of the proceedings, and has given full and fair hearing to all parties making or -desiring to make any such protest, objection or to offer testimony, and has fully examined and considered all of said evidence, matters, testimony and objections offered; and based upon same, said City Council finds that all objections and pro- tests should be overruled and denied except to the extent of the reduction in rates and adjustments in said assessments hereinafter made and shown in Section 4 hereof; and said City Council further finds that each and every parcel of property abutting upon said street within the limits to be improved as herein defined, will be enhanced in value and specially benefited by the construction of said improvements in an amount equal to or in excess of the amount of the cost of said improvements, as herein adjusted, proposed to be, and as herein, assessed against each of said parcels of property abutting upon said streets, and the real and true owners thereof; and said City Council did consider and correct all errors, invalidities, or deficiencies called to its attention and did find that all proceedings were proper and in accordance with the laws under which same are being had and the proceedings of said City Council theretofore had with reference to such improvements and that all of same are in all respects valid and regular; and said City Council further finds upon said evidence that the assessments hereinbelow made and the charges hereby declared against said abutting properties and the real and true owners thereof are just and equitable and did adopt the rule of apportionment set forth herein and the division of the costs of said improvements between abutting properties and the real and true owners thereof, as being just and equitable and as producing substantial equality considering the benefits to be received and the burdens imposed thereby, and that all objections and protests should be overruled and denied. SECTION 2: That there being no further protests or testimony for or against or in reference to said improvements, benefits or proceedings, said hearing granted to the real and true owners of properties abutting upon said street within the limits herein defined, and to all persons, firms, corporations and estates, owning or claiming same or any interest therein be, and the same is hereby closed and all protests and objections, whether specifically mentioned or not, shall be, and the same are hereby overruled and denied, except such thereof as relate to, and to the extent of, the adjustments hereinafter made in Section 4 hereof_ SECTION 3: The City Council hereby finds and determines upon the evidence heard in reference to each and every parcel of property abutting upon each of said streets, within the limits herein defined, that'the special benefits in the enhance- ment in value to accrue to said property, and the real and true owners thereof, by virtue of the construction of said improvements in said portions of said streets, -5- will be equal to or in excess of the amount of the cost of said improvements, as herein adjusted, proposed to be, and as herein, assessed against said abutting properties, and the real and true owners thereof, and finds that the apportionment of the costs of said improvements, and that the assessments hereinbelow made, are just and equitable and produce substantial equality, considering the benefits re- ceived and the burdens imposed thereby, and are in accordance with the laws of the State of Texas and the Charter of said City, and that all proceedings heretofore had with reference to said improvements are in all respects regular, proper and valid, and that all prerequisities to the fixing to the assessment liens against said abutting properties, and the personal liability of the real and true owners thereof, whether named or correctly named herein or not, have been in all things regularly had and performed in compliance with the law, and the proceedings of said City Council. SECTION 4: That in pursuance of said Ordinance, duly enacted by said City Council authorizing and ordering the improvement of said above described streets within the limits hereinabove defined, and in pursuance of said proceedings heretofore had and enacted by said City Council in reference to said improvements and by virtue of the powers vested in said City with respect to said street im- provements by the laws of the State of Texas, with particular reference to Chapter 106 of the Acts of the First Called Session of the 40th Legislature of the State of Texas, known and shown as Article 1105 -b of Vernon's Annotated Civil Statutes of Texas, as amended, and as adopted by Section 7, Article I of the Charter of the City of Baytown, Texas, there shall be, and is hereby levied, assessed and taxed against the respective parcels of property abutting upon said streets, as hereinbelow described, and against the real and true owners thereof, whether such real and true owners be named or correctly named, or said properties be correctly described herein or not, the several sums of money hereinbelow men- tioned opposite the description of such property, and the several amounts assessed against same and the real and true owners thereof, and the names of the apparent owners thereof, all as corrected and adjusted by said City Council, being as follows, to -wit: (HERE INSERT ASSESSMENT ROLLS) co N co N V Ol cn N 4::h W (D N fl) (D (D (D (D 0 O (n O Q Ln �X J Z:M - C- r- 7C -ice-, Q WC —O CD -Aw W m O J. C C7 In E O ::$ O O -5 O O -h - J• o p a w Q O O cam+ C (A C/) O w O 01 O c C In n fn n Cr Cr Ct' S C+ =- Q rD rD CD rD _d .. i IZ i Q G• C p O v V co W O O J J fi p O n n ME: 7. 77 O p O O N N N In C!• C+ rD rD z z -0 v p O c c rD CD w v+ n n CL O O O O M rD rD rD ;u 7: +n rD I I 1 i v1 •--{ 1 1 1 k V1 O d O O O ct 1 I I 1 rD Al C+ SECTION 5: That the several sums mentioned above in Section 4 hereof, assessed against said parcels of abutting property and the real and true owner or owners thereof, whether said owners be named or correctly named, herein or not, together with interest thereon at the rate of eight per cent (8%) per annum and with reasonable attorneys' fees and all costs and expense of collection, if incurred, are hereby declared to be and made a first and prior lien upon the re- spective parcels of property against which same are assessed from and after the date said improvements were ordered by said City Council, and a personal liability and charge against the real and true owner or owners thereof, whether or not such owner, or owners, be named, or correctly named herein, paramount and superior to all other liens, claims or titles except for lawful ad valorem taxes; and should more than one person, firm or corporation, own an interest in any of said parcels of abutting property, each such person firm or corporation shall be personally liable for his, her, or its pro rata part of the total assessment levied against said property in proportion as his, her or its interest in said property bears to the total ownership of such property, whether or not such interest, or the amount, or name of the owner thereof, be set out herein, or in the certificate issued in evidence of such assessment, and such interest of any such person, firm or corporation in such property may be discharged and released from said assessment and lien upon the payment of such proportionate part of said total assessment, together with interest at the above stated rate to date of payment, to the legal holder of such assessment; and that the sums so assessed shall be payable as follows, to -wit: in six (6) equal annual installments, due respectively thirty (30) days one (1), two (2), three (3), four (4), five (5) six (6) years from the date of acceptance of such improvements by the City, together with interest on each installment from said date of acceptance until paid at the rate of eight percent (8%) per annum payable annually; provided, however, that the owners of any of said property shall have the privilege of paying all or any of said installments at any time before maturity thereof by paying the total amount of principal of such installment together with interest accrued thereon down to the date of payment. Further, if default be made in the payment of any -7- of said installments of principal or interest promptly as the same matures, then at the option of the City of Baytown, or its assigns, the entire amount of the assessment upon which default is made, together with reasonable attorney's fees and all collection costs, incurred, shall be and become immediately due and payable. SECTION 6: That the City of Baytown shall pay the entire contract price to the successful bidder and reimburse itself for the cost of the im- provements with the sums hereby assessed against said abutting property and the owners thereof, and said City shall, exercise all of its lawful powers to enforce and collect said assessment thereof; and if default shall be made in the payment of any of said sums herein assessed against the said parcels of abutting property, and the real and true owner or owners thereof, collection thereof shall be enforced either by suit in any court having jurisdiction, or by sale of the property assessed as nearly as possible in the manner as may be provided by law in force in said City for the sale of property for the collection of ad valorem taxes. SECTION 7: That for the purpose of evidencing said assessments, the liens securing same and the several sums assessed against the said parcels of abutting property, and the real and true owner or owners thereof, and the time and terms of payment, and to aid in the enforcement thereof, assignable certi- ficates shall be issued by the City of Baytown, Texas, upon the completion and acceptance of said improvements in said street, which certificates shall be executed by the Mayor in the name of the City, attested by the City Clerk with the Corporate Seal, and which certificates shall set forth and evidence the assessments levied, and shall declare the amounts of said assessments and the times and terms thereof, the rate of interest thereon, the date of the com- pletion and the acceptance of the improvements for which the certificate is issued, and shall contain the name of the apparent owner or owners, and the description of the property assessed by lot and block number or such other description as may be sufficient to identify the same, and if the said property in shall be owned by an estate or firm, then to so state the fact shall be suf- ficient, and no error or mistake in describing any such property or in giving the name of any owner or owners, or otherwise, shall in anywise invalidate or impair the assessment levied hereby or the certificate issued in evidence thereof. That the said certificate shall further provide substantially that if default shall be made in the payment of any installment of principal or interest when due, then at the option of said City, or its assigns, or the holder thereof, the whole of said assessment evidenced thereby shall at once become due and payable and shall be collectable with reasonable attorney's fees and all expenses and costs of collection, if incurred, and said certificate shall set forth and evidence the personal liability of the real and true owner or owners of such property, whether named or correctly named therein or not, and the lien upon such property, and that said lien is first and paramount thereon, superior to all other liens, titles and charges, except for lawful ad valorem taxes, from and after the date said improvements were ordered by said City Council, and shall provide in effect, that if default shall be made in the payment thereof, the same may be enforced, at the option of said City, or its assigns, either by the sale of the property therein described in the manner provided for the collection of ad valorem taxes as above recited, or by suit in any court having jurisdiction. That said certificate shall further recite in effect that all the pro- ceedings with reference to making said improvements have been regularly had in compliance with the law and Charter in force in said City and proceedings of the City Council of said City, and that all prerequisites to the fixing of the assessment lien against the property and the personal liability of the real and true owners or owner thereof, evidenced by such certificates have been regularly done and performed, which recitals shall be evidence of all the matters and facts so recited, and no further proof thereof shall be required in any Court. That said certificates shall further provide in effect that the City of Baytown, Texas, shall exercise all of its lawful powers, when requested so 10 to do by the holder of said certificates, to aid in the enforcement and collection thereof, and said certificates may contain other and further recitals pertinent and appropriate thereto, It shall not be necessary that said certificates shall be in the exact form as above set forth, but the substance and effect thereof shall suffice, and that the foregoing provisions as to the contents of said cer- tificates are directory only. Provided however, that the failure to issue any such certificate or certificates shall in no way invalidate any of the assessments herein levied but such assessments shall in any event be valid and due and payable as herein provided. SECTION S: That it is the intention of said City Council herein to, and it does hereby, levy, assess and charge the assessments in the amounts as hereinabove set out, upon and against each and every parcel of property abutting upon said street and within the limits above defined, whether or not such property be accurately described herein, so that, nevertheless, each and every parcel of property abutting upon said street and the real and true owner or owners thereof shall be, and is hereby, charged and assessed with its portion of the costs of such improvements, at the amounts hereinabove set out in said limits herein de- fined. That all such assessments levied are, and shall be, a personal liability and charge against the respective real and true owner or owners of said abutting properties, notwithstanding such owner or owners may not be named or correctly named, and any irregularity in the name of the property owner, or the description of any property or the amount of any assessment, or in any other matter or thing shall not in anywise invalidate or impair any assessment or lien levied hereby or any certificate issued hereunder, and any such mistake, or error, invalidity or irregularity, whether in such assessment or in the certificate issued in evi- dence thereof, may be, but is not required to be, in order to be enforceable, corrected at any time by the City Council of the City of Baytown, Texas. That the total amounts assessed against the respective parcels of property abutting upon said streets within the limits herein defined, and the real and true owner or owners thereof, are the same, or less than, the estimates of said as- sessments prepared by the City's Engineer and approved and adopted by said City -lO- Council, and are in accordance with the proceedings of said City relative to said improvements and assessments therefor, and with the terms, powers and provisions of said Chapter 106 of the Acts of the First Called Session of the 40th Legislature of the State of Texas, known as Article 1105 -b of Vernon's Annotated Civil Statutes of Texas, as amended, and as adopted by Section 7, Article I of the Charter of said City, under which terms, provisions and powers of said Acts said improvements and assessments were had and made by said City Council. SECTION 9: Effective Date: This ordinance shall take effect from and after the date of its passage by a majority of the City Council of the City of Baytown, Texas.
