Ordinance No. 1,268ORDINANCE NO. 1268 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF BROWN & ROOT, INC., FOR THE CONSTRUCTION OF PHASE II, OF THE 1972 STREET IMPROVEMENT PROGRAM AND AU- THORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF ONE HUNDRED FORTY -EIGHT THOUSAND ONE HUNDRED FIFTY - SEVEN AND 95/100 ($148,157.95) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown, Texas, did authorize Jack Morton, City Engineer for the City of Baytown, to advertise for bids for the construction of Phase II, 1972 Street Improvement Program to be received August 25, 1972; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes, Article 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 3:00 o'clock p.m., Friday, August 25, 1972, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown, Texas, hereby accepts the bid of Brown & Root, Inc. for the construction of Phase II, 1972 Street Improvement Program which includes the following streets: Nebraska (New Jersey to Oklahoma), Dailey (Neal to Pruett), Knowlton (Highway 146 to Colony Madrid), West Cleveland (Morris to South Main), Houston (Ward to Cedar Bayou Road), East Humble (South Fourth to Highway 146), Yupon (Nazro to Riggs), Fortinberry (Dorris to Myers), North Fifth (East James to Ruth), Ruth (112 Block West of North Fifth to Highway 146), and California (Florida to New Mexico), according to the plans and specifications set forth by the City Engineer on a construction timetable of 110 days for the sum of One Hundred Forty -Eight Thousand One Hundred Fifty -Seven and 95/100 ($148,157.95) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Brown & Root, Inc. for the construction of said Phase II, 1972 Street Improvement Program containing the plans, specifications and requirements of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. INTRODUCED, READ and PASSED by the affirmative vote of the City Council on the 29th day of August , 1972.
