AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ACCEPTING THE BID OF RIGGS CONSTRUCTION COMPANY FOR THE CON-
STRUCTION OF THE MEMORIAL FOUNTAIN AT THE BAYTOWN CIVIC CENTER
AND FOUNDATION SLAB FOR THE PARKS & RECREATION DEPARTMENT MAINTENANCE
BUILDING FOR THE SUM OF SEVEN THOUSAND TWO HUNDRED AND NO /100
($7,200) DOLLARS, CONTINGENT UPON ACCEPTANCE OF THE ALTERATION
OF THE BID TO EXCLUDE VARIOUS SIDEWALKS, WITH REGARD TO SUCH
AGREEMENT.
WHEREAS, the City Council of the City of Baytown, Texas, did authorize
A. J. Busch, Consulting Engineer for the City of Baytown, to advertise for bids
for the construction of the Memorial Fountain at the Baytown Civic Center,
foundation slab for the Parks & Recreation Department Maintenance Building,
and various sidewalks in the City of Baytown to be received August 16, 1972; and
WHEREAS, notice to bidders as to the time and place, when and where the
contract for said construction would be let was published pursuant to provisions
of Vernon's Civil Statutes Article 2368a; and
WHEREAS, all bids were opened and publicly read at City Hall at 10:00
a.m., Wednesday, August 16, 1972, as per the published notice to bidders.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby
accepts the bid of Riggs Construction Company for the construction of the Memorial
Fountain at the Baytown Civic Center and foundation slab for the Parks & Recreation
Maintenance Building for the sum of Seven Thousand Two Hundred and No /100 ($7,200)
Dollars, contingent upon acceptance of the alteration of the bid to exclude var-
ious sidewalks, according to the plans and specifications set forth by the Con-
sulting Engineer, and the Mayor and City Clerk of the City are hereby authorized
and directed to execute and attest to a contract with Riggs Construction Company
for the construction of said Memorial Fountain at the Baytown Civic Center and
foundation slab for the Parks & Recreation Department Maintenance Building,
containing the plans, specifications and requirements of the Consulting Engineer
and appropriate bond and drawn provisions in accordance with the provisions of
Vernon's Civil Statutes, Article 5160 or lump sum payment provisions in accordance
with the provisions of Vernon's Civl Statutes, Article 2368a.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council
on this 17th day of August, 1972.
