Ordinance No. 1,254r ORDINANCE NO. 1254 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 2, ADMINISTRATION, SO AS TO RE- PEAL SECTION 2 -1, AUXILIARY POLICE DEPARTMENT, CREATED; SUBJECT TO CHIEF OF POLICE, AS PRESENTLY CONSTITUTED AND TO SUBSTITUTE IN ITS PLACE A NEW SECTION] 2 -1, POLICE RESERVE FORCE; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, Section 2 -1 of the Code of Ordinances of the City of Baytown created the Baytown Auxiliary Police Department; and WHEREAS, such Auxiliary Police Department is not authorized by State Statutes; and WHEREAS, Article 998a of Vernon's Annotated Civil Statutes provides for creation of a Police Reserve Force by the governing body of any city, town, or village; and WHEREAS, the City Council of the City of Baytown, Texas, deems it de- sirable to have a Police Reserve Force; NOVI THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That an organization called the Police Reserve Force be established within the City of Baytown, Texas. Section 2: Membership within the Police Reserve Force shall be at the discretion of the Chief of Police and shall be limited to twenty members. Section 3: Members of the Police Reserve Force shall serve at the discretion of the Chief of Police and may be called into service at any time the Chief of Police considers it necessary to have additional officers to pre- serve the peace and enforce the law. Section 4: Reserve Police Officers shall act only in a supplementary capacity to the regular police force and in no case assume the full time duties of regular police officers without first complying with all requirements for such regular police officers. Section 5: Members of the Police Reserve Force shall conform with min- imum training standards for all reserve law enforcement officers which have been established by the Commission on Law Enforcement Officer Standards and Education. Section 6: No person appointed to the Police Reserve Force may carry a weapon or otherwise act as a peace officer until he has been approved by the City Council. After approval, he may carry a weapon only when authorized by the Chief of Police, and when discharging official duties as a duly constituted peace officer. Section 7: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordi- nances regulating and governing the subject matter covered by this ordinance. Section 8: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 9: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
