Ordinance No. 1,248ORDINANCE NO. 1248 AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A LICENSED AGREEMENT FOR THE EXTENSION OF THE CITY'S WATERMAIN THROUGH THE EXISTING RIGHT -OF -WAY OF THE MISSOURI PACIFIC RAIL- ROAD AND SOUTHERN PACIFIC RAILROAD; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Baytown is desirous of extending and improving its present watermain pipelines; and WHEREAS, said extension requires the City to cross the existing right -of -way of the Missouri Pacific Railroad and Southern Pacific Railroads; and WHEREAS, the Missouri Pacific Railroad has tendered a licensed agree- meets to the City thereby authorizing the City to cross its right -of -way and further providing for a payment of One Hundred and No /100 ($100.00) Dollars fee per license; and WHEREAS, the Southern Pacific Railroad has tendered the City a licensed agreement authorizing the City to cross its existing right -of -way; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Mayor and City Clerk of the City of Baytown are hereby authorized to enter into a licensed agreement with Missouri Pacific Railroad for the crossing of their existing right -of -way with a twelve (12) inch water main. The location of said crossing being described in the li- censed agreement as follows, to -wit: BEING approximately located 1519 feet west of Mile Post No. 33 in Baytown, Texas; and Section 2: That the Mayor and City Clerk of the City of Baytown are hereby authorized to enter into a licensed agreement with Missouri Pacific Railroad for the crossing of their existing right -of -way with a sixteen (16) inch water main. The location of said crossing being described in the licensed agreement as follows, to -wit: BEING approximately located 1806 feet south of Mile Post No. 33 in Baytown, Texas. Section 3: The Mayor and City Clerk for the City of Baytown, Texas, are authorized to enter into a licensed agreement with the Southern Pacific Transportation Company for the crossing of its railroad property with a twelve (12) inch water main. The location of the crossing as described in the licensed agreement is as follows, to -wit: A twelve (12) inch water pipeline crossing beneath Railroad's Baytown Main Track at Mile Post 22.89 in Pruett Street, County of Harris, Baytown, Texas. Section 4: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
